1 A bill to be entitled
2 An act relating to motor vehicles; creating the
3 Interstate 95 Lane Designation Pilot Project in
4 Palm Beach County; providing legislative
5 purpose; requiring heavy trucks to use the two
6 outermost lanes; providing penalties for
7 violation; directing the Department of
8 Transportation to erect signs; requiring
9 posting of signs prior to citation for
10 violation; providing for repeal; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Interstate 95 Lane Designation Pilot
16 Project in Palm Beach County.--
17 (1) There is created the Interstate 95 Lane
18 Designation Pilot Project in Palm Beach County. The purpose of
19 the project is to increase motorist safety, improve the flow
20 of traffic, and reduce the wear and tear on Interstate 95 by
21 requiring heavy trucks to use the two outermost lanes on that
22 highway in Palm Beach County. The pilot project shall last for
23 2 years.
24 (2) Any heavy truck having three or more axles shall
25 operate only on the two outermost right-hand lanes on
26 Interstate 95 within the boundaries of Palm Beach County,
27 except when the vehicle is preparing for a left turn, avoiding
28 a hazardous condition on the road, or directed by a law
29 enforcement officer or other authorized official.

1 (3) A violation of subsection (2) is a noncriminal
2 traffic infraction, punishable as a moving violation as
3 provided in chapter 318, Florida Statutes.
4 (4) The Department of Transportation is directed to
5 erect suitable signs informing operators of heavy trucks and
6 other motorists of the lane requirements in subsection (2).
7 There shall be no citation for a violation of subsection (2)
8 unless such signs have been erected and are clearly visible to
9 motorists.
10 (5) This act is repealed October 1, 2005.
11 Section 2. This act shall take effect October 1, 2003.
