14 On page 4, lines 16 through 26, delete those lines
15
16 and insert:
17 Section 5. Subsections (7), (8), and (9) are added to
18 section 430.502, Florida Statutes, to read:
19 430.502 Alzheimer's disease; memory disorder clinics
20 and day care and respite care programs.--
21 (7) The Agency for Health Care Administration and the
22 department shall seek a federal waiver to implement a Medicaid
23 home and community-based waiver targeted to persons with
24 Alzheimer's disease to test the effectiveness of Alzheimer's
25 specific interventions to delay or to avoid institutional
26 placement.
27 (8) The department will implement the waiver program
28 specified in subsection (7). The agency and the department
29 shall ensure that providers are selected that have a history
30 of successfully serving persons with Alzheimer's disease. The
31 department and the agency shall develop specialized standards

1 for providers and services tailored to persons in the early,
2 middle, and late stages of Alzheimer's disease and designate a
3 level of care determination process and standard that is most
4 appropriate to this population. The department and the agency
5 shall include in the waiver services designed to assist the
6 caregiver in continuing to provide in-home care. The
7 department shall implement this waiver program subject to a
8 specific appropriation or as provided in the General
9 Appropriations Act. The department and the agency shall submit
10 their program design to the President of the Senate and the
11 Speaker of the House of Representatives for consultation
12 during the development process.
13 (9) Authority to continue the waiver program specified
14 in subsection (7) shall be automatically eliminated at the
15 close of the 2008 Regular Session of the Legislature unless
16 further legislative action is taken to continue it prior to
17 such time.
18 Section 6. This act shall take effect July 1, 2003.

4 not contingent upon an appropriation; creating

7 violations, citations, and penalties imposed
8 against child care facilities regulated by the
9 state; requiring the Department of Children and
10 Family Services to consult and meet the
11 requirements of the State Technology Office;
12 specifying database capabilities and uses of
13 information contained therein; requiring
14 implementation not contingent upon an
15 appropriation; directing the Department of
16 Children and Family Services to adopt a rule
17 defining child care; amending s. 430.502, F.S.;
18 requiring the Agency for Health Care
19 Administration and the Department of Health to
20 seek and implement a Medicaid home and
21 community-based waiver for persons with
22 Alzheimer's disease; requiring the development
23 of waiver program standards; providing for
24 consultation with the presiding officers of the
25 Legislature; providing for a contingent future
26 repeal of such waiver program; providing an
27 effective date.
