8 the U.S. Paratroopers license plate;
9 restricting eligibility to purchase such
10 plates; amending s. 320.08056, F.S.; creating
11 the Protect Our Reefs license plate; amending
12 s. 320.08058, F.S.; requiring that the license
13 plate use fee from the Florida Arts license
14 plate be transferred directly to the county
15 arts council; providing for the distribution of
16 the annual use fee from the Protect Our Reef
17 license plate received from the sale of such
18 plates; providing for audit by the Auditor
19 General; providing effective dates.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Paragraph (mm) is added to subsection (4)
24 of section 320.08056, Florida Statutes, to read:
25 320.08056 Specialty license plates.--
26 (4) The following license plate annual use fees shall
27 be collected for the appropriate specialty license plates:
28 (mm) Military Services license plate, $15.
29 Section 2. Subsection (39) is added to section
30 320.08058, Florida Statutes, to read:

1 (39) MILITARY SERVICES LICENSE PLATES.--
2 (a) The department shall develop a series of military
3 services license plates for the United States Army, Navy, Air
4 Force, and Coast Guard as provided in this section. The word
5 "Florida" must appear at the top of the plate, and the word
6 "Army," "Navy," "Air Force," or "Coast Guard" must appear at
7 the bottom of the plate. The appropriate logo for the
8 particular branch of the military must appear on the left side
9 of the plate, approximately 3 inches in diameter.
10 (b) The annual use fees shall be deposited into the
11 State Homes for Veterans Trust Fund and must be used solely to
12 construct, operate, and maintain domiciliary and nursing homes
13 for veterans, subject to the requirements of chapter 216.
14 Section 3. Section 320.0891, Florida Statutes, is
15 created to read:
16 320.0891 U.S. Paratroopers license plate.--
17 (1) The department shall develop a U.S. Paratroopers
18 license plate as provided in this section. The U.S.
19 Paratroopers license plate must bear the colors and design
20 approved by the department. The word "Florida" must appear at
21 the top of the plate, and the words "U.S. Paratroopers" must
22 appear at the bottom of the plate. The Airborne Wings and
23 Glider Wings logo must appear in black on the left side of the
24 plate, centered from top to bottom. The plate must have a
25 white background with red and blue letters or numbers.
26 (2) U.S. Paratroopers license plates may only be
27 purchased by current or former United States military
28 personnel who, as part of their military duty, have been
29 trained to jump from flying aircraft.
30 (3) Each owner or lessee of an automobile or truck for
31 private use, truck weighing not more than 7,999 pounds, or

1 recreational vehicle as specified in s. 320.08(9)(c) or (d),
2 which is not used for hire or commercial use, who is a
3 resident of this state and who meets the qualifications
4 contained in subsection (2) shall, upon application therefor
5 to the department, with the payment of the taxes and fees
6 described in subsection (5), be issued a U.S. Paratroopers
7 license plate. Each application must be accompanied by proof
8 that the applicant has been decorated as a parachutist or has
9 completed the U.S. Army Jump School.
10 (4) The department is responsible for developing the
11 license plate authorized in this section. The department shall
12 begin production and distribution within one year.
13 (5) Each request must be made annually to the
14 department, accompanied by the following tax and fees:
15 (a) The license tax required for the vehicle as set
16 forth in s. 320.08.
17 (b) A processing fee of $2.
18 (c) A license plate fee as required under s.
19 320.06(1)(b).
20 (d) A license plate annual use fee of $20.
21 (6) The department shall retain all annual use fee
22 revenues from the sale of the U.S. Paratroopers license plates
23 until all startup costs for developing and issuing the plates
24 are recovered, not to exceed $60,000. Thereafter, the annual
25 use fee revenues shall be distributed to the State Homes for
26 Veterans Trust Fund.
27 Section 4. Effective July 1, 2003, paragraph (mm) is
28 added to subsection (4) of section 320.08056, Florida
29 Statutes, to read:

1 (4) The following license plate annual use fees shall
2 be collected for the appropriate specialty license plates:
3 (mm) Protect Our Reefs license plate, $25.
4 Section 5. Effective July 1, 2003, paragraph (b) of
5 subsection (12) of section 320.08058, Florida Statutes, is
6 amended and subsection (39) is added to that section, to read:
7 320.08058 Specialty license plates.--
8 (12) FLORIDA ARTS LICENSE PLATES.--
9 (b) The license plate annual use fees are to be
10 annually distributed as follows:
11 1. All fees collected must be forwarded quarterly to
12 the single arts council officially designated by the county in
13 direct proportion to the amounts of fees collected in each
14 county. If there is no county arts council, fees collected
15 must be forwarded to such other agency in the county as the
16 highest ranking county administrative official designates, to
17 be applied by the arts council or agency to support arts
18 organizations, arts programs, and arts activities within the
19 county Division of Cultural Affairs of the Department of
20 State, together with a report setting forth the amount of such
21 fees collected in each county, and must be deposited into the
22 Florida Fine Arts Trust Fund.
23 2. The Division of Cultural Affairs shall distribute
24 the fees forwarded to it by the department to the counties in
25 the amounts set forth in the report required under
26 subparagraph 1., in each case to the county arts council for
27 such county or, if there is none, to such other agency in the
28 county as the division designates, to be applied by the
29 council or agency to support art organizations, programs, and
30 activities within the county.
31 (39) PROTECT OUR REEFS LICENSE PLATES.--

1 (a) The department shall develop a Protect Our Reefs
2 license plate as provided in this section. Protect Our Reefs
3 license plates must bear the colors and design approved by the
4 department. The word "Florida" must appear at the top of the
5 plate, and the words "Protect Our Reefs" must appear at the
6 bottom of the plate.
7 (b) The proceeds of the annual use fee shall be
8 distributed to Mote Marine Laboratory, Inc., to fund Florida
9 reef research, conservation, and education programs. Up to 15
10 percent of the funds received by Mote Marine Laboratory, Inc.,
11 may be expended for annual administrative costs directly
12 associated with the administration of the Protect Our Reefs
13 program. Up to 10 percent of the funds received by Mote Marine
14 Laboratory, Inc., may be used by Mote Marine Laboratory, Inc.,
15 for the continuing promotion and marketing of the license
16 plate. After reimbursement for documented costs expended in
17 the establishment of the plate, Mote Marine Laboratory, Inc.,
18 shall use and distribute the remaining funds to eligible
19 Florida-based scientific, conservation, and education
20 organizations for the collection, analysis, and distribution
21 of scientific, educational, and conservation information to
22 the research community; federal, state, and local government
23 agencies; educational institutions; and the public. Eligible
24 organizations shall be based in Florida and engaged in reef
25 research, conservation, or education.
26 (c) The state Auditor General may examine any records
27 of Mote Marine Laboratory, Inc., and any other organization
28 that receives funds from the sale of the Protect Our Reefs
29 license plate, to determine compliance with law.
30 Section 6. Except as otherwise specifically provided
31 in this act, this act shall take effect October 1, 2003.
