12 s. 320.08058, F.S.; requiring that the license
13 plate use fee from the Florida Arts license
14 plate be transferred directly to the county
15 arts council; providing for the distribution of
16 the annual use fee from the Protect Our Reef
17 license plate received from the sale of such
18 plates; providing for audit by the Auditor
19 General; amending ss. 320.08056, 320.08058,
20 F.S.; creating a Fish Florida license plate;
21 providing for the distribution of annual use
22 fees received from the sale of such plates;
23 providing effective dates.

25 Be It Enacted by the Legislature of the State of Florida:
26
27 Section 1. Paragraph (mm) is added to subsection (4)
28 of section 320.08056, Florida Statutes, to read:
29 320.08056 Specialty license plates.--
30 (4) The following license plate annual use fees shall
31 be collected for the appropriate specialty license plates:

1 (mm) Military Services license plate, $15.
2 Section 2. Subsection (39) is added to section
3 320.08058, Florida Statutes, to read:
4 320.08058 Specialty license plates.--
5 (39) MILITARY SERVICES LICENSE PLATES.--
6 (a) The department shall develop a series of military
7 services license plates for the United States Army, Navy, Air
8 Force, and Coast Guard as provided in this section. The word
9 "Florida" must appear at the top of the plate, and the word
10 "Army," "Navy," "Air Force," or "Coast Guard" must appear at
11 the bottom of the plate. The appropriate logo for the
12 particular branch of the military must appear on the left side
13 of the plate, approximately 3 inches in diameter.
14 (b) The annual use fees shall be deposited into the
15 State Homes for Veterans Trust Fund and must be used solely to
16 construct, operate, and maintain domiciliary and nursing homes
17 for veterans, subject to the requirements of chapter 216.
18 Section 3. Section 320.0891, Florida Statutes, is
19 created to read:
20 320.0891 U.S. Paratroopers license plate.--
21 (1) The department shall develop a U.S. Paratroopers
22 license plate as provided in this section. The U.S.
23 Paratroopers license plate must bear the colors and design
24 approved by the department. The word "Florida" must appear at
25 the top of the plate, and the words "U.S. Paratroopers" must
26 appear at the bottom of the plate. The Airborne Wings and
27 Glider Wings logo must appear in black on the left side of the
28 plate, centered from top to bottom. The plate must have a
29 white background with red and blue letters or numbers.
30 (2) U.S. Paratroopers license plates may only be
31 purchased by current or former United States military

1 personnel who, as part of their military duty, have been
2 trained to jump from flying aircraft.
3 (3) Each owner or lessee of an automobile or truck for
4 private use, truck weighing not more than 7,999 pounds, or
5 recreational vehicle as specified in s. 320.08(9)(c) or (d),
6 which is not used for hire or commercial use, who is a
7 resident of this state and who meets the qualifications
8 contained in subsection (2) shall, upon application therefor
9 to the department, with the payment of the taxes and fees
10 described in subsection (5), be issued a U.S. Paratroopers
11 license plate. Each application must be accompanied by proof
12 that the applicant has been decorated as a parachutist or has
13 completed the U.S. Army Jump School.
14 (4) The department is responsible for developing the
15 license plate authorized in this section. The department shall
16 begin production and distribution within one year.
17 (5) Each request must be made annually to the
18 department, accompanied by the following tax and fees:
19 (a) The license tax required for the vehicle as set
20 forth in s. 320.08.
21 (b) A processing fee of $2.
22 (c) A license plate fee as required under s.
23 320.06(1)(b).
24 (d) A license plate annual use fee of $20.
25 (6) The department shall retain all annual use fee
26 revenues from the sale of the U.S. Paratroopers license plates
27 until all startup costs for developing and issuing the plates
28 are recovered, not to exceed $60,000. Thereafter, the annual
29 use fee revenues shall be distributed to the State Homes for
30 Veterans Trust Fund.

1 Section 4. Effective July 1, 2003, paragraph (mm) is
2 added to subsection (4) of section 320.08056, Florida
3 Statutes, to read:
4 320.08056 Specialty license plates.--
5 (4) The following license plate annual use fees shall
6 be collected for the appropriate specialty license plates:
7 (mm) Protect Our Reefs license plate, $25.
8 Section 5. Effective July 1, 2003, paragraph (b) of
9 subsection (12) of section 320.08058, Florida Statutes, is
10 amended and subsection (39) is added to that section, to read:
11 320.08058 Specialty license plates.--
12 (12) FLORIDA ARTS LICENSE PLATES.--
13 (b) The license plate annual use fees are to be
14 annually distributed as follows:
15 1. All fees collected must be forwarded quarterly to
16 the single arts council officially designated by the county in
17 direct proportion to the amounts of fees collected in each
18 county. If there is no county arts council, fees collected
19 must be forwarded to such other agency in the county as the
20 highest ranking county administrative official designates, to
21 be applied by the arts council or agency to support arts
22 organizations, arts programs, and arts activities within the
23 county Division of Cultural Affairs of the Department of
24 State, together with a report setting forth the amount of such
25 fees collected in each county, and must be deposited into the
26 Florida Fine Arts Trust Fund.
27 2. The Division of Cultural Affairs shall distribute
28 the fees forwarded to it by the department to the counties in
29 the amounts set forth in the report required under
30 subparagraph 1., in each case to the county arts council for
31 such county or, if there is none, to such other agency in the

1 county as the division designates, to be applied by the
2 council or agency to support art organizations, programs, and
3 activities within the county.
4 (39) PROTECT OUR REEFS LICENSE PLATES.--
5 (a) The department shall develop a Protect Our Reefs
6 license plate as provided in this section. Protect Our Reefs
7 license plates must bear the colors and design approved by the
8 department. The word "Florida" must appear at the top of the
9 plate, and the words "Protect Our Reefs" must appear at the
10 bottom of the plate.
11 (b) The proceeds of the annual use fee shall be
12 distributed to Mote Marine Laboratory, Inc., to fund Florida
13 reef research, conservation, and education programs. Up to 15
14 percent of the funds received by Mote Marine Laboratory, Inc.,
15 may be expended for annual administrative costs directly
16 associated with the administration of the Protect Our Reefs
17 program. Up to 10 percent of the funds received by Mote Marine
18 Laboratory, Inc., may be used by Mote Marine Laboratory, Inc.,
19 for the continuing promotion and marketing of the license
20 plate. After reimbursement for documented costs expended in
21 the establishment of the plate, Mote Marine Laboratory, Inc.,
22 shall use and distribute the remaining funds to eligible
23 Florida-based scientific, conservation, and education
24 organizations for the collection, analysis, and distribution
25 of scientific, educational, and conservation information to
26 the research community; federal, state, and local government
27 agencies; educational institutions; and the public. Eligible
28 organizations shall be based in Florida and engaged in reef
29 research, conservation, or education.
30 (c) The state Auditor General may examine any records
31 of Mote Marine Laboratory, Inc., and any other organization

1 that receives funds from the sale of the Protect Our Reefs
2 license plate, to determine compliance with law.
3 Section 6. Paragraph (mm) is added to subsection (4)
4 of section 320.08056, Florida Statutes, to read:
5 320.08056 Specialty license plates.--
6 (4) The following license plate annual use fees shall
7 be collected for the appropriate specialty license plates:
8 (mm) Fish Florida license plate, $22.
9 Section 7. Subsection (39) is added to section
10 320.08058, Florida Statutes, to read:
11 320.08058 Specialty license plates.--
12 (39) "FISH FLORIDA" LICENSE PLATES.--
13 (a) The department shall develop a Fish Florida
14 license plate as provided in this section. The word "Florida"
15 must appear at the top of the plate, and the words "Fish
16 Florida!" must appear at the bottom of the plate.
17 (b) The annual use fees shall be distributed to the
18 Florida Foundation for Responsible Angling, Inc., to fund
19 aquatic education; marine resource stewardship, and ethical
20 angling practices in this state. A maximum of 15 percent of
21 the funds received by the foundation may be used for
22 administrative costs directly associated with the foundation's
23 grant distribution program and license plate funding. A
24 maximum of 10 percent of the funds may be used for continuing
25 promotion and marketing of the license plate. The foundation
26 shall provide for a peer review grant solicitation and award
27 process to distribute the remainder of the funds to benefit
28 aquatic education, marine resource stewardship, and ethical
29 angling practices in this state.
30 Section 8. Except as otherwise specifically provided
31 in this act, this act shall take effect October 1, 2003.
