  2         An act relating to specialty license plates;

  3         creating s. 320.0891, F.S.; creating the U.S.

  4         Paratroopers license plate; restricting

  5         eligibility to purchase such plates; amending

  6         s. 320.08056, F.S.; creating the Protect Our

  7         Reefs license plate; amending s. 320.08058,

  8         F.S.; requiring that the license plate use fee

  9         from the Florida Arts license plate be

10         transferred directly to the county arts

11         council; providing for the distribution of the

12         annual use fee from the Protect Our Reef

13         license plate received from the sale of such

14         plates; providing for audit by the Auditor

15         General; amending ss. 320.08056, 320.08058,

16         F.S.; creating a Fish Florida license plate;

17         providing for the distribution of annual use

18         fees received from the sale of such plates;

19         providing effective dates.

21  Be It Enacted by the Legislature of the State of Florida:

22  

23         Section 1.  Section 320.0891, Florida Statutes, is

24  created to read:

25         320.0891  U.S. Paratroopers license plate.--

26         (1)  The department shall develop a U.S. Paratroopers

27  license plate as provided in this section. The U.S.

28  Paratroopers license plate must bear the colors and design

29  approved by the department. The word "Florida" must appear at

30  the top of the plate, and the words "U.S. Paratroopers" must

31  appear at the bottom of the plate. The Airborne Wings and

 1  Glider Wings logo must appear in black on the left side of the

 2  plate, centered from top to bottom. The plate must have a

 3  white background with red and blue letters or numbers.

 4         (2)  U.S. Paratroopers license plates may only be

 5  purchased by current or former United States military

 6  personnel who, as part of their military duty, have been

 7  trained to jump from flying aircraft.

 8         (3)  Each owner or lessee of an automobile or truck for

 9  private use, truck weighing not more than 7,999 pounds, or

10  recreational vehicle as specified in s. 320.08(9)(c) or (d),

11  which is not used for hire or commercial use, who is a

12  resident of this state and who meets the qualifications

13  contained in subsection (2) shall, upon application therefor

14  to the department, with the payment of the taxes and fees

15  described in subsection (5), be issued a U.S. Paratroopers

16  license plate. Each application must be accompanied by proof

17  that the applicant has been decorated as a parachutist or has

18  completed the U.S. Army Jump School.

19         (4)  The department is responsible for developing the

20  license plate authorized in this section. The department shall

21  begin production and distribution within one year.

22         (5)  Each request must be made annually to the

23  department, accompanied by the following tax and fees:

24         (a)  The license tax required for the vehicle as set

25  forth in s. 320.08.

26         (b)  A processing fee of $2.

27         (c)  A license plate fee as required under s.

28  320.06(1)(b).

29         (d)  A license plate annual use fee of $20.

30         (6)  The department shall retain all annual use fee

31  revenues from the sale of the U.S. Paratroopers license plates

 1  until all startup costs for developing and issuing the plates

 2  are recovered, not to exceed $60,000. Thereafter, the annual

 3  use fee revenues shall be distributed to the State Homes for

 4  Veterans Trust Fund.

 5         Section 2.  Effective July 1, 2003, paragraph (mm) is

 6  added to subsection (4) of section 320.08056, Florida

 7  Statutes, to read:

 8         320.08056  Specialty license plates.--

 9         (4)  The following license plate annual use fees shall

10  be collected for the appropriate specialty license plates:

11         (mm)  Protect Our Reefs license plate, $25.

12         Section 3.  Effective July 1, 2003, paragraph (b) of

13  subsection (12) of section 320.08058, Florida Statutes, is

14  amended and subsection (39) is added to that section, to read:

15         320.08058  Specialty license plates.--

16         (12)  FLORIDA ARTS LICENSE PLATES.--

17         (b)  The license plate annual use fees are to be

18  annually distributed as follows:

19         1.  All fees collected must be forwarded quarterly to

20  the single arts council officially designated by the county in

21  direct proportion to the amounts of fees collected in each

22  county. If there is no county arts council, fees collected

23  must be forwarded to such other agency in the county as the

24  highest ranking county administrative official designates, to

25  be applied by the arts council or agency to support arts

26  organizations, arts programs, and arts activities within the

27  county Division of Cultural Affairs of the Department of

28  State, together with a report setting forth the amount of such

29  fees collected in each county, and must be deposited into the

30  Florida Fine Arts Trust Fund.

 1         2.  The Division of Cultural Affairs shall distribute

 2  the fees forwarded to it by the department to the counties in

 3  the amounts set forth in the report required under

 4  subparagraph 1., in each case to the county arts council for

 5  such county or, if there is none, to such other agency in the

 6  county as the division designates, to be applied by the

 7  council or agency to support art organizations, programs, and

 8  activities within the county.

 9         (39)  PROTECT OUR REEFS LICENSE PLATES.--

10         (a)  The department shall develop a Protect Our Reefs

11  license plate as provided in this section. Protect Our Reefs

12  license plates must bear the colors and design approved by the

13  department. The word "Florida" must appear at the top of the

14  plate, and the words "Protect Our Reefs" must appear at the

15  bottom of the plate.

16         (b)  The proceeds of the annual use fee shall be

17  distributed to Mote Marine Laboratory, Inc., to fund Florida

18  reef research, conservation, and education programs. Up to 15

19  percent of the funds received by Mote Marine Laboratory, Inc.,

20  may be expended for annual administrative costs directly

21  associated with the administration of the Protect Our Reefs

22  program. Up to 10 percent of the funds received by Mote Marine

23  Laboratory, Inc., may be used by Mote Marine Laboratory, Inc.,

24  for the continuing promotion and marketing of the license

25  plate. After reimbursement for documented costs expended in

26  the establishment of the plate, Mote Marine Laboratory, Inc.,

27  shall use and distribute the remaining funds to eligible

28  Florida-based scientific, conservation, and education

29  organizations for the collection, analysis, and distribution

30  of scientific, educational, and conservation information to

31  the research community; federal, state, and local government

 1  agencies; educational institutions; and the public. Eligible

 2  organizations shall be based in Florida and engaged in reef

 3  research, conservation, or education.

 4         (c)  The state Auditor General may examine any records

 5  of Mote Marine Laboratory, Inc., and any other organization

 6  that receives funds from the sale of the Protect Our Reefs

 7  license plate, to determine compliance with law.

 8         Section 4.  Paragraph (mm) is added to subsection (4)

 9  of section 320.08056, Florida Statutes, to read:

10         320.08056  Specialty license plates.--

11         (4)  The following license plate annual use fees shall

12  be collected for the appropriate specialty license plates:

13         (mm)  Fish Florida license plate, $22.

14         Section 5.  Subsection (39) is added to section

15  320.08058, Florida Statutes, to read:

16         320.08058  Specialty license plates.--

17         (39)  "FISH FLORIDA" LICENSE PLATES.--

18         (a)  The department shall develop a Fish Florida

19  license plate as provided in this section. The word "Florida"

20  must appear at the top of the plate, and the words "Fish

21  Florida!" must appear at the bottom of the plate.

22         (b)  The annual use fees shall be distributed to the

23  Florida Foundation for Responsible Angling, Inc., to fund

24  aquatic education; marine resource stewardship, and ethical

25  angling practices in this state. A maximum of 15 percent of

26  the funds received by the foundation may be used for

27  administrative costs directly associated with the foundation's

28  grant distribution program and license plate funding. A

29  maximum of 10 percent of the funds may be used for continuing

30  promotion and marketing of the license plate. The foundation

31  shall provide for a peer review grant solicitation and award

 1  process to distribute the remainder of the funds to benefit

 2  aquatic education, marine resource stewardship, and ethical

 3  angling practices in this state.

 4         Section 6.  Except as otherwise specifically provided

 5  in this act, this act shall take effect October 1, 2003.
