1 A bill to be entitled
2 An act relating to service of process against
3 the Florida Automobile Joint Underwriting
4 Association; amending s. 627.311, F.S.;
5 specifying that the Florida Automobile Joint
6 Underwriting Association appoints the Chief
7 Financial Officer as agent for service of
8 process purposes; requiring the association to
9 file certain information with the Department of
10 Financial Services; providing a limitation
11 relating to method of service of process;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (6) is added to section 627.311,
17 Florida Statutes, to read:
18 627.311 Joint underwriters and joint reinsurers.--
19 (6)(a) The Florida Automobile Joint Underwriting
20 Association created under this section shall be deemed to have
21 appointed the Chief Financial Officer and his or her
22 successors in office as its agent to receive service of all
23 legal process issued against it in any civil action or
24 proceeding in this state. Process so served shall be valid and
25 binding upon the insurer.
26 (b) The association shall file with the Department of
27 Financial Services a designation of the name and address of
28 the person to whom process against it served upon the Chief
29 Financial Officer is to be forwarded. The association may
30 change the designation at any time by a new filing.

1 (c) Service of process upon the Chief Financial
2 Officer as the association's agent pursuant to such an
3 appointment shall be the sole method of service of process
4 upon the association.
5 Section 2. This act shall take effect upon becoming a
6 law.
