  1                      A bill to be entitled

  2         An act relating to service of process against

  3         the Florida Automobile Joint Underwriting

  4         Association; amending s. 627.311, F.S.;

  5         specifying that the Florida Automobile Joint

  6         Underwriting Association appoints its general

  7         manager as agent for service of process

  8         purposes; providing a limitation relating to

  9         method of service of process; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (6) is added to section 627.311,

15  Florida Statutes, to read:

16         627.311  Joint underwriters and joint reinsurers.--

17         (6)(a)  The Florida Automobile Joint Underwriting

18  Association created under this section shall be deemed to have

19  appointed its general manager as its agent to receive service

20  of all legal process issued against it in any civil action or

21  proceeding in this state. Process so served shall be valid and

22  binding upon the association.

23         (b)  Service of process upon the general manager as the

24  association's agent pursuant to such an appointment shall be

25  the sole method of service of process upon the association.

26         Section 2.  This act shall take effect upon becoming a

27  law.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1960

 3                                 

 4  The committee substitute deletes the Chief Financial Officer
    as agent for service of process for the Florida Automobile
 5  Joint Underwriting Association (FAJUA) and inserts the General
    Manager of the FAJUA to carry out this function.
