1 A bill to be entitled
2 An act relating to juvenile proceedings;
3 amending s. 985.219, F.S.; providing the time
4 period within which a juvenile must be brought
5 for an adjudicatory hearing; repealing Rule
6 8.090, Florida Rules of Juvenile Procedure,
7 relating to a speedy trial, to the extent that
8 it is inconsistent with the act; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Present subsections (9), (10), (11), and
14 (12) of section 985.219, Florida Statutes, are redesignated as
15 subsections (10), (11), (12), and (13), respectively, and a
16 new subsection (9) is added to that section to read:
17 985.219 Process and service.--
18 (9) If a petition is filed alleging the child to have
19 committed a delinquent act, the child shall be brought to an
20 adjudicatory hearing without demand within 90 days after the
21 earlier of:
22 (a) The date the child was taken into custody; or
23 (b) The date the summons issued upon the filing of a
24 petition is served.
25 Section 2. Rule 8.090, Florida Rules of Juvenile
26 Procedure, relating to speedy trial, is repealed to the extent
27 that it is inconsistent with this act.
28 Section 3. This act shall take effect upon becoming a
29 law, but section 2 shall take effect only if this act is
30 passed by the affirmative vote of two-thirds of the membership
31 of each house of the Legislature.
