11  Senator Pruitt moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 42, line 15, through
15            page 43, line 23,  delete those lines
16  
17  and insert:  
18         Section 34.  Subsection (5) of section 497.361, Florida
19  Statutes, is amended, and subsections (6) and (7) are added to
20  that section, to read:
21         497.361  Registration of monument establishments.--
22         (5)  Monuments not shall be delivered within a
23  specified timeframe shall be considered a breach of contract
24  unless the monument establishment has a written agreement to
25  extend the delivery date.  The purchaser shall be entitled to
26  a refund of all money paid for the merchandise.  Such refund
27  shall be made within 30 days after receipt by the monument
28  establishment of the purchaser's written request for a refund.
29  This subsection does not preclude the purchase and
30  installation of a new monument from any other registered
31  monument establishment or certificateholder as established by

 1  this chapter and installed no later than 120 days after the
 2  date of sale. The establishment may request two 30-day
 3  extensions. Extensions may be granted by the executive
 4  director.
 5         (6)  All contracts with the public must be approved by
 6  the Department of Financial Services and must provide a
 7  complete description of any monument, marker, or related
 8  product to be delivered.
 9         (7)  A registration may not be transferred or assigned.
