4 Kirkpatrick State Reserve; directing the Office
5 of Greenways and Trails of the Department of
6 Environmental Protection to develop
7 multipurpose recreational opportunities and
8 provide supervision of the area; allowing
9 public hunting; authorizing the Division of
10 State Lands to acquire adjacent or contiguous
11 property; requiring the Division of State Lands
12 to notify persons with easements in the area;
13 requiring a report; providing an effective
14 date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Section 258.166, Florida Statutes, is
19 created to read:
20 258.166 George Kirkpatrick State Reserve
21 designated.--There is designated and established a state
22 reserve to be known as George Kirkpatrick State Reserve, in
23 Marion and Putnam Counties, which shall include all
24 state-owned lands within the floodplain of the Oklawaha River
25 and those hereafter acquired by the state from Eureka Dam in
26 Marion County to Buckman Lock in Putnam County. Those lands
27 are deemed and held to be a state reserve, under the
28 supervision of the Office of Greenways and Trails of the
29 Department of Environmental Protection. The office is charged
30 with the duty of providing for the development of multipurpose
31 recreational opportunities at this reserve and the care,

1 upkeep, maintenance, and beautification of the George
2 Kirkpatrick State Reserve, including all those dams, locks,
3 and other structures transferred by the Federal Government to
4 the state. Any action that would substantially alter the area
5 encompassing the reserve as the area existed on January 1,
6 2003, must be approved by general law. However, nothing in
7 this section precludes the Office of Greenways and Trails of
8 the Department of Environmental Protection from performing
9 necessary maintenance and improvements as required for the
10 continued operation of the dams, locks, or other structures
11 and facilities within the state reserve.
12 (1) Public hunting is allowed in the state reserve as
13 authorized by the Fish and Wildlife Conservation Commission.
14 (2) The Division of State Lands of the Department of
15 Environmental Protection may acquire in the name of the Board
16 of Trustees of the Internal Improvement Trust Fund any
17 additional property adjacent or contiguous to the George
18 Kirkpatrick State Reserve from private owners or from the
19 United States Government for improved management and
20 recreational opportunities.
21 (3) The Division of State Lands shall identify,
22 contact, and inform all property owners who hold easements
23 located within the taking line of the Rodman Reservoir of the
24 designation of this area as a state reserve.
25 (4) By January 1, 2004, the Division of State Lands
26 shall submit a report to the Executive Office of the Governor,
27 the President of the Senate, and the Speaker of the House of
28 Representatives which:
29 (a) Identifies the entities that hold easements within
30 the taking line of the reservoir.

1 (b) Indicates whether the holder of an easement is
2 willing to sell the easement.
3 (c) Estimates the cost of acquiring the easements.
4 (d) Identifies any additional issues resulting from
5 this designation.
6 Section 2. This act shall take effect upon becoming a
7 law.

COMMITTEE SUBSTITUTE FOR

12 The committee substitute creates the George Kirkpatrick State
Reserve in Marion and Putnam counties, and provides that the
13 Office of Greenways and Trails in the Department of
Environmental Protection will have supervision of the State
14 Reserve. The committee substitute provides that the area
encompassing the Reserve as the area existed on January 1,
15 2003, may not be altered unless approved by general law,
except that the Office of Greenways and Trails is authorized
16 to perform necessary maintenance and improvements as required
for the continued operation of the dams, locks, or other
17 structures and facilities within the State Reserve.
