2 An act relating to state reserves; creating s.
3 258.166, F.S.; establishing the George
4 Kirkpatrick State Reserve; directing the Office
5 of Greenways and Trails of the Department of

7 multipurpose recreational opportunities and
8 provide supervision of the area; allowing
9 public hunting; authorizing the Division of
10 State Lands to acquire adjacent or contiguous
11 property; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 258.166, Florida Statutes, is
16 created to read:
17 258.166 George Kirkpatrick State Reserve
18 designated.--There is designated and established a state
19 reserve to be known as George Kirkpatrick State Reserve, in
20 Marion and Putnam Counties, which shall include all
21 state-owned lands within the floodplain of the Oklawaha River
22 and those hereafter acquired by the state from Eureka Dam in
23 Marion County to Buckman Lock in Putnam County. Those lands
24 are deemed and held to be a state reserve, under the
25 supervision of the Office of Greenways and Trails of the
26 Department of Environmental Protection. The office is charged
27 with the duty of providing for the development of multipurpose
28 recreational opportunities at this reserve and the care,
29 upkeep, maintenance, and beautification of the George
30 Kirkpatrick State Reserve, including all those dams, locks,
31 and other structures transferred by the Federal Government to

1 the state. Any action that would substantially alter the area
2 encompassing the reserve as the area existed on January 1,
3 2003, must be approved by general law. However, nothing in
4 this section precludes the Office of Greenways and Trails of
5 the Department of Environmental Protection from performing
6 necessary maintenance and improvements as required for the
7 continued operation of the dams, locks, or other structures
8 and facilities within the state reserve.
9 (1) Public hunting is allowed in the state reserve as
10 authorized by the Fish and Wildlife Conservation Commission.
11 (2) The Division of State Lands of the Department of
12 Environmental Protection may acquire in the name of the Board
13 of Trustees of the Internal Improvement Trust Fund any
14 additional property adjacent or contiguous to the George
15 Kirkpatrick State Reserve from private owners or from the
16 United States Government for improved management and
17 recreational opportunities.
18 Section 2. This act shall take effect January 1, 2004.
