11  Senator Aronberg moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 2, lines 1-18, delete those lines
15  
16  and insert:  
17         (3)  A civil action or an administrative proceeding may
18  not be filed against a court-appointed psychologist as a
19  result of a child custody evaluation unless the court
20  appointing the psychologist first finds, upon petition of any
21  party to the action or proceeding, that the psychologist
22  failed to act in good faith in conducting the child custody
23  evaluation. If the court finds a lack of good faith, the court
24  shall appoint another psychologist to conduct a further child
25  custody evaluation. The court shall make a determination as to
26  who is responsible for the court costs and attorney's fees
27  associated with this section.
