11  Senator Aronberg moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         On page 1, line 30, through
15            page 2, line 9, delete those lines
16  
17  and insert:  
18         (3)  A parent who wishes to file a legal action against
19  a court-appointed psychologist who has acted in good faith in
20  conducting a child custody evaluation must petition the judge
21  who presided over the child custody proceeding to appoint
22  another psychologist. Upon the parent's showing of good cause,
23  the court shall appoint another psychologist. The court shall
24  make a determination as to who is responsible for all court
25  costs and attorney's fees associated with making such an
26  appointment.
27         (4)  If a legal action, whether it be a civil action, a
28  criminal action, or an administrative proceeding, is filed
29  against a court-appointed psychologist in a child custody
30  proceeding, the claimant is responsible for all reasonable
31  costs and reasonable attorney's fees associated with the

 1  action for both parties if the psychologist is held not
 2  liable. If the psychologist is held liable in civil court, the
 3  psychologist must pay all reasonable costs and reasonable
 4  attorney's fees for the claimant.
