  1                      A bill to be entitled

  2         An act relating to law enforcement officers;

  3         amending s. 322.21, F.S.; revising delinquent

  4         fee for described late renewal or extension of

  5         certain driver's licenses; providing for

  6         deposit of funds into the State Law Enforcement

  7         Officer Recruitment and Retention Trust Fund

  8         for certain purposes; providing an effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Paragraph (c) of subsection (1) and

14  subsection (5) of section 322.21, Florida Statutes, are

15  amended to read:

16         322.21  License fees; procedure for handling and

17  collecting fees.--

18         (1)  Except as otherwise provided herein, the fee for:

19         (c)  The renewal or extension of a Class D or Class E

20  driver's license or of a license restricted to motorcycle use

21  only is $15, except that a delinquent fee of $10 $1 shall be

22  added for a renewal or extension made not more than 60 days 12

23  months after the license expiration date. The fee provided in

24  this paragraph shall include the fee for driver's education

25  provided by s. 1003.48.

26         (5)(a)  Except as otherwise provided in this

27  subsection, the department shall collect and transmit all fees

28  received by it under this section to the Treasurer to be

29  placed in the General Revenue Fund of the state, and

30  sufficient funds for the necessary expenses of the department

 1  shall be included in the appropriations act. The fees shall be

 2  used for the maintenance and operation of the department.

 3         (b)  Nine dollars of the moneys received from each $10

 4  delinquent fee imposed pursuant to paragraph (1)(c) shall be

 5  deposited into the State Law Enforcement Officer Recruitment

 6  and Retention Trust Fund and credited to the salaries and

 7  benefit category of the state agencies with eligible sworn

 8  agency law enforcement officers on a pro rata, per capita

 9  basis pursuant to the ratified collective bargaining agreement

10  for the state law enforcement bargaining unit then in effect.

11  If no such ratified bargaining agreement is then in effect,

12  the amounts shall be distributed on the basis of the ratified

13  bargaining agreement last in effect. The amounts collected and

14  distributed pursuant to this paragraph are supplemental to

15  other funds provided for salary increases.

16         Section 2.  This act shall take effect July 1, 2003.

18          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
19                         Senate Bill 2060

21  This CS increases the delinquent fee for renewing or extending
    a driver's license from $1 to $10, and provides a renewal or
22  extension of driver's license is not delinquent until 60 days
    after the license has expired. The CS provides $9 of the $10
23  fee must be used for state law enforcement pay raises.
