  1                      A bill to be entitled

  2         An act relating to charter technical career

  3         centers; amending s. 1002.34, F.S.; allowing

  4         charter technical career sponsors to submit

  5         full-time-enrollment membership data as defined

  6         in the charter agreement; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (11) of section 1002.34, Florida

12  Statutes, is amended to read:

13         1002.34  Charter technical career centers.--

14         (11)  FUNDING.--

15         (a)  Notwithstanding any other provision of law, a

16  charter technical career center's student membership

17  enrollment must be calculated pursuant to this section.

18         (b)(a)  Each district school board and community

19  college that sponsors a charter technical career center shall

20  pay directly to the center an amount stated in the charter.

21  State funding shall be generated for the center for its

22  student enrollment and program outcomes as provided in law.  A

23  center is eligible for funding from the Florida Workforce

24  Development Education Fund, the Florida Education Finance

25  Program, and the Community College Program Fund, depending

26  upon the programs conducted by the center.

27         (c)(b)  A center may receive other state and federal

28  aid, grants, and revenue through the district school board or

29  community college board of trustees.

30         (d)(c)  A center may receive gifts and grants from

31  private sources.

 1         (e)(d)  A center may not levy taxes or issue bonds, but

 2  it may charge a student tuition fee consistent with authority

 3  granted in its charter and permitted by law.

 4         (f)(e)  A center shall provide for an annual financial

 5  audit in accordance with s. 218.39.

 6         (g)(f)  A center must define in the charter agreement

 7  the delivery system in which the instructional offering of

 8  educational services will be placed. The rules governing this

 9  provider educational delivery system must be applied to all of

10  the center's students and must authorize all other sponsoring

11  educational systems to report required enrollment and student

12  data as necessary, relying solely on the documentation

13  required of the instructional provider sponsor. The

14  educational system sponsors may submit their comparable data

15  based solely on the rules of the offering institution, and

16  each sponsor will earn full-time-equivalent membership for

17  each student for funding and reporting purposes. A center must

18  provide instruction for at least the number of days required

19  by law for other public schools or community colleges, as

20  appropriate, and may provide instruction for additional days.

21         Section 2.  This act shall take effect July 1, 2003.
