1 A bill to be entitled
2 An act relating to funding for school
3 districts; amending s. 1011.62, F.S.; deleting
4 the restriction to fiscal year 2002-2003 on the
5 transfer of categorical funds to school board
6 specified academic classroom instruction;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (b) of subsection (5) of section
12 1011.62, Florida Statutes, is amended to read:
13 1011.62 Funds for operation of schools.--If the annual
14 allocation from the Florida Education Finance Program to each
15 district for operation of schools is not determined in the
16 annual appropriations act or the substantive bill implementing
17 the annual appropriations act, it shall be determined as
18 follows:
19 (5) CATEGORICAL FUNDS.--
20 (b) For fiscal year 2002-2003, If a district school
21 board finds and declares in a resolution adopted at a regular
22 meeting of the school board that the funds received for any of
23 the following categorical appropriations are urgently needed
24 to maintain school board specified academic classroom
25 instruction, the school board may consider and approve an
26 amendment to the school district operating budget transferring
27 the identified amount of the categorical funds to the
28 appropriate account for expenditure:
29 1. Funds for student transportation.
30 2. Funds for in-service educational personnel
31 training.

3 5. Funds for teacher recruitment and retention.

5 Section 2. This act shall take effect July 1, 2003.
