14         On page 6, line 28, through
15            page 7, line 11, delete those lines
16  
17  and insert:  performing the duties of a certified nursing
18  assistant. Unless otherwise approved by the agency, licensed
19  nurses counted towards the minimum staffing requirements for
20  certified nursing assistants must exclusively perform the
21  duties of a certified nursing assistant for the entire shift
22  and shall not also be counted towards the minimum staffing
23  requirements for licensed nurses. If the agency approved a
24  facility's request to use a licensed nurse to perform both
25  licensed nursing and certified nursing assistant duties, the
26  facility must allocate the amount of staff time specifically
27  spent on certified nursing assistant duties for the purpose of
28  documenting compliance with minimum staffing requirements for
29  certified and licensed nursing staff. In no event may the
30  hours of a licensed nurse with dual job responsibilities be
31  counted twice.
