2 An act relating to enterprise zones; amending
3 s. 290.00675, F.S.; authorizing the Office of
4 Tourism, Trade, and Economic Development to
5 amend the boundaries of specified communities
6 and increasing the population limit thereof;
7 amending s. 290.00676, F.S.; extending the
8 deadline for requests to amend rural enterprise
9 zone boundaries; creating s. 290.00679, F.S.;
10 authorizing the amendment of the boundaries of
11 certain rural enterprise zones after
12 recommendation of Enterprise Florida, Inc., and
13 upon recommendation of the local development
14 agency; creating s. 290.00684, F.S.;
15 authorizing Escambia County to apply to the
16 Office of Tourism, Trade, and Economic
17 Development for designation of one enterprise
18 zone, notwithstanding certain limitations;
19 providing requirements with respect thereto;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Section 290.00675, Florida Statutes, is
25 amended to read:
26 290.00675 Amendment of certain enterprise zone
27 boundaries.--Notwithstanding any other provisions of law, the
28 Office of Tourism, Trade, and Economic Development may amend
29 the boundaries of an area designated as an enterprise zone in
30 a community having a population of 235,000 persons but less
31 than 260,000 245,000, so long as the area does not increase

1 the overall size of the zone by greater than 25 acres and the
2 increased area is contiguous to the existing enterprise zone.
3 The amendment must also be consistent with the limitations
4 imposed by s. 290.0055 upon establishment of the enterprise
5 zone.
6 Section 2. Subsection (3) of section 290.00676,
7 Florida Statutes, is amended to read:
8 290.00676 Amendment of rural enterprise zone
9 boundaries.--Notwithstanding any other law, upon
10 recommendation by Enterprise Florida, Inc., the Office of
11 Tourism, Trade, and Economic Development may approve requests
12 to amend the boundaries of rural enterprise zones as defined
13 in s. 290.004(8). Boundary amendments authorized by this
14 section are subject to the following requirements:
15 (3) The local enterprise zone development agency must
16 request the amendment from Enterprise Florida, Inc., prior to
17 December 30, 2003 2001. The request must contain maps and
18 sufficient information to allow the office to determine the
19 number of noncontiguous areas and the total size of the rural
20 enterprise zone.
21 Section 3. Section 290.00679, Florida Statutes, is
22 created to read:
23 290.00679 Amendment to certain rural enterprise zone
24 boundaries.--Notwithstanding any other law, upon
25 recommendation by Enterprise Florida, Inc., the Office of
26 Tourism, Trade, and Economic Development may approve requests
27 to amend the boundaries of rural enterprise zones as defined
28 in s. 290.004(8). Boundary amendments authorized by this
29 section are subject to the following requirements:
30 (1) The amendment may increase the size of the rural
31 enterprise zone up to a maximum zone size of 20 square miles.

1 (2) For purposes of this section, the pervasive
2 poverty criterion may be set aside.
3 (3) The local enterprise zone development agency must
4 request the amendment from Enterprise Florida, Inc., before
5 December 31, 2003. The request must contain maps and
6 sufficient information to allow the office to determine the
7 total size of the rural enterprise zone.
8 Section 4. Enterprise zone designation for Escambia
9 County.--Escambia County may apply to the Office of Tourism,
10 Trade, and Economic Development for designation of one
11 enterprise zone within the county encompassing an area which
12 shall not exceed 20 square miles and shall have a contiguous
13 boundary or shall consist of not more than three noncontiguous
14 areas. The application must be submitted by December 31, 2003,
15 and must comply with the requirements of section 290.0055,
16 Florida Statutes, except section 290.0055(3), Florida
17 Statutes. Notwithstanding the provisions of section 290.0065,
18 Florida Statutes, limiting the total number of enterprise
19 zones designated and the number of enterprise zones within a
20 population category, the Office of Tourism, Trade, and
21 Economic Development may designate one enterprise zone under
22 this section. The Office of Tourism, Trade, and Economic
23 Development shall establish the initial effective date of the
24 enterprise zone designated pursuant to this section.
25 Section 5. This act shall take effect upon becoming a
26 law.
