1 A bill to be entitled
2 An act relating to continuing education for
3 public adjusters; amending s. 626.869, F.S.;
4 requiring continuing education for public
5 adjusters; providing requirements; requiring
6 the Financial Services Commission to adopt
7 rules; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (5) of section 626.869, Florida
12 Statutes, is amended to read:
13 626.869 License, adjusters.--
14 (5)(a) Any person holding a license for 24 consecutive
15 months or longer and who engages in adjusting workers'
16 compensation insurance must, beginning in their birth month
17 and every 2 years thereafter, have completed 24 hours of
18 courses, 2 hours of which relate to ethics, in subjects
19 designed to inform the licensee regarding the current workers'
20 compensation laws of this state, so as to enable him or her to
21 engage in business as a workers' compensation insurance
22 adjuster fairly and without injury to the public and to adjust
23 all claims in accordance with the policy or contract and the
24 workers' compensation laws of this state.
25 (b) Any individual holding a license as a public
26 adjuster for 24 consecutive months or longer, beginning in
27 their birth month and every 2 years thereafter, must have
28 completed 24 hours of courses, 2 hours of which relate to
29 ethics, in subjects designed to inform the licensee regarding
30 the current laws of this state pertaining to all lines of
31 insurance other than life and annuities, so as to enable him

1 or her to engage in business as an adjuster fairly and without
2 injury to the public and to adjust all claims in accordance
3 with the policy or contract and laws of this state.
4 (c) In order to qualify as an eligible course under
5 this subsection, the course must:
6 1.(a) Have a course outline approved by the
7 department.
8 2.(b) Be taught at a school training facility or other
9 location approved by the department.
10 3.(c) Be taught by instructors with at least 5 years
11 of experience in the area of workers' compensation, general
12 lines of insurance, or other persons approved by the
13 department. However, a member of The Florida Bar is exempt
14 from the 5 years' experience requirement.
15 4.(d) Furnish the attendee a certificate of
16 completion. The course provider shall send a roster to the
17 department in a format prescribed by the department.
18 (d) The Financial Services Commission shall adopt
19 rules necessary to implement and administer the continuing
20 education requirements of this subsection.
21 Section 2. This act shall take effect upon becoming a
22 law.
