  1                      A bill to be entitled

  2         An act relating to self-propelled knives;

  3         amending s. 790.225, F.S.; clarifying the

  4         definition of self-propelled knife, the

  5         unlawful manufacture, display, sale, ownership,

  6         possession, or use of which is prohibited;

  7         providing nonapplicability; providing a

  8         penalty; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 790.225, Florida Statutes, is

13  amended to read:

14         790.225  Ballistic self-propelled knives; unlawful to

15  manufacture, sell, or possess; forfeiture; penalty.--

16         (1)  It is unlawful for any person to manufacture,

17  display, sell, own, possess, or use a ballistic self-propelled

18  knife which is a device that propels a knifelike blade as a

19  projectile and which physically separates the blade from the

20  device by means of a coil spring, elastic material, or

21  compressed gas. A ballistic self-propelled knife is declared

22  to be a dangerous or deadly weapon and a contraband item. It

23  shall be subject to seizure and shall be disposed of as

24  provided in s. 790.08(1) and (6).

25         (2)  This section shall not apply to:

26         (a)  Any device from which a knifelike blade opens,

27  where such blade remains physically integrated with the device

28  when open.

29         (b)  Any device which propels an arrow, a bolt, or a

30  dart by means of any common bow, compound bow, crossbow, or

31  underwater spear gun.

 1         (3)  Any person violating the provisions of subsection

 2  (1) is guilty of a misdemeanor of the first degree, punishable

 3  as provided in s. 775.082 or s. 775.083.

 4         Section 2.  This act shall take effect upon becoming a

 5  law.
