  2         An act relating to K-20 education

  3         accountability; amending s. 1008.31, F.S.;

  4         expanding legislative intent for the K-20

  5         education performance accountability system;

  6         providing requirements and an implementation

  7         schedule for performance-based funding;

  8         providing mission, goals, and measures;

  9         requiring collection of certain data; amending

10         s. 1008.36, F.S.; providing eligibility

11         criteria for participation in the Florida

12         School Recognition Program; providing an

13         effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Section 1008.31, Florida Statutes, is

18  amended to read:

19         1008.31  Florida's K-20 education performance

20  accountability system; legislative intent; performance-based

21  funding; mission, goals, and systemwide measures.--

22         (1)  LEGISLATIVE INTENT.--It is the intent of the

23  Legislature that:

24         (a)  The performance accountability system implemented

25  to assess the effectiveness of Florida's seamless K-20

26  education delivery system provide answers to the following

27  questions in relation to its mission and goals:

28         1.  What is the public receiving in return for funds it

29  invests in education?

30         2.  How effectively is Florida's K-20 education system

31  educating its students?

 1         3.  How effectively are the major delivery sectors

 2  promoting student achievement?

 3         4.  How are individual schools and postsecondary

 4  education institutions performing their responsibility to

 5  educate their students as measured by how students are

 6  performing and how much they are learning?

 7         (b)  The K-20 education performance accountability

 8  system be established as a single, unified accountability

 9  system with multiple components, including, but not limited

10  to, measures of adequate yearly progress, individual student

11  learning gains, school grades, and return on investment.

12         (c)  The K-20 education performance accountability

13  system comply with the accountability requirements of the "No

14  Child Left Behind Act of 2001," PL 107-110.

15         (d)(b)  The State Board of Education recommend to the

16  Legislature systemwide performance standards; the Legislature

17  establish systemwide performance measures and standards; and

18  the systemwide measures and standards provide Floridians with

19  information on what the public is receiving in return for the

20  funds it invests in education and how well the K-20 system

21  educates its students.

22         (e)(c)  The State Board of Education establish

23  performance measures and set performance standards for

24  individual components of the public education system,

25  including individual schools and postsecondary educational

26  institutions, with measures and standards based primarily on

27  student achievement.

28         (2)  PERFORMANCE-BASED FUNDING.--

29         (a)  The State Board of Education shall cooperate with

30  the Commissioner of Education and each delivery system to

31  develop proposals for performance-based funding, using

 1  performance measures adopted pursuant to this section

 2  established by the Legislature.

 3         (b)  The State Board of Education proposals must

 4  provide that at least 10 percent of the state funds

 5  appropriated for the K-20 education system are conditional

 6  upon meeting or exceeding established performance standards.

 7  The State Board of Education must submit the recommendations

 8  to the Legislature in the following sequence:

 9         (a)  By December 1, 2002, recommendations for state

10  universities, for consideration by the 2003 Legislature and

11  implementation in the 2003-2004 fiscal year.

12         (b)  By December 1, 2003, recommendations for public

13  schools and workforce education, for consideration by the 2004

14  Legislature and implementation in the 2004-2005 fiscal year.

15         (c)  By December 1, 2004, recommendations for community

16  colleges, for consideration by the 2005 Legislature and

17  implementation in the 2005-2006 fiscal year.

18         (d)  By December 1, 2005, recommendations for all other

19  programs that receive state funds within the Department of

20  Education.

21         (c)  The State Board of Education shall adopt

22  guidelines required to implement performance-based funding

23  that allow 1 year to demonstrate achievement of specified

24  performance standards prior to a reduction in appropriations

25  pursuant to this section.

26         (d)  By December 1, 2003, the State Board of Education

27  shall adopt common definitions, measures, standards, and

28  performance improvement targets required to:

29         1.  Use the state core measures and the sector-specific

30  measures to evaluate the progress of each sector of the

 1  educational delivery system toward meeting the systemwide

 2  goals for public education.

 3         2.  Notify the sectors of their progress in achieving

 4  the specified measures so that they may develop improvement

 5  plans that directly influence decisions about policy, program

 6  development, and management.

 7         3.  Implement the performance-based budgeting system

 8  described in this section.

 9         (e)  During the 2003-2004 fiscal year, the Department

10  of Education shall collect data required to establish

11  progress, rewards, and sanctions.

12         (f)  By December 1, 2004, the Department of Education

13  shall recommend to the Legislature a formula for

14  performance-based funding that applies accountability

15  standards for the individual components of the public

16  education system at every level, kindergarten through graduate

17  school.  Effective for the 2004-2005 fiscal year and

18  thereafter, performance-based funds shall be allocated based

19  on the progress, rewards, and sanctions established pursuant

20  to this section.

21         (3)  MISSION, GOALS, AND SYSTEMWIDE MEASURES.--

22         (a)  The mission of Florida's K-20 education system

23  shall be to increase the proficiency of all students within

24  one seamless, efficient system, by allowing them the

25  opportunity to expand their knowledge and skills through

26  learning opportunities and research valued by students,

27  parents, and communities.

28         (b)  The State Board of Education shall adopt guiding

29  principles for establishing state and sector-specific

30  standards and measures.

 1         (c)  The State Board of Education shall, and to

 2  maintain an accountability system that measures student

 3  progress toward the following goals:

 4         1.(a)  Highest student achievement, as measured by:

 5  student FCAT performance and annual learning gains; the number

 6  and percentage of schools that improve at least one school

 7  performance grade designation or maintain a school performance

 8  grade designation of "A" pursuant to s. 1008.34; graduation or

 9  completion rates at all learning levels; and other measures

10  identified in law or rule.

11         2.(b)  Seamless articulation and maximum access, as

12  measured by: the percentage of students who demonstrate

13  readiness for the educational level they are entering, from

14  kindergarten through postsecondary education and into the

15  workforce; the number and percentage of students needing

16  remediation; the percentage of Floridians who complete

17  associate, baccalaureate, graduate, professional, and

18  postgraduate degrees; the number and percentage of credits

19  that articulate; the extent to which each set of exit-point

20  requirements matches the next set of entrance-point

21  requirements; the degree to which underserved populations

22  access educational opportunity; the extent to which access is

23  provided through innovative educational delivery strategies;

24  and other measures identified in law or rule.

25         3.(c)  Skilled workforce and economic development, as

26  measured by: the number and percentage of graduates employed

27  in their areas of preparation; the percentage of Floridians

28  with high school diplomas and postsecondary education

29  credentials; the percentage of business and community members

30  who find that Florida's graduates possess the skills they

 1  need; national rankings; and other measures identified in law

 2  or rule.

 3         4.(d)  Quality efficient services, as measured by: cost

 4  per completer or graduate; average cost per noncompleter at

 5  each educational level; cost disparity across institutions

 6  offering the same degrees; the percentage of education

 7  customers at each educational level who are satisfied with the

 8  education provided; and other measures identified in law or

 9  rule.

10         (4)  SYSTEMWIDE DATA COLLECTION.--School districts and

11  public postsecondary educational institutions shall maintain

12  information systems that will provide the State Board of

13  Education and the Legislature with information and reports

14  necessary to address the specifications of the accountability

15  system. The State Board of Education shall determine the

16  standards for the required data. at a The level of

17  comprehensiveness and quality shall be no less than that which

18  was available as of June 30, 2001.

19         Section 2.  Subsections (3) and (4) of section 1008.36,

20  Florida Statutes, are amended to read:

21         1008.36  Florida School Recognition Program.--

22         (3)  All public schools, including charter schools,

23  that receive a school grade pursuant to s. 1008.34 are

24  eligible to participate in the program. Schools that do not

25  receive a school grade may be eligible to participate in the

26  program based upon other accountability measures approved by

27  the State Board of Education.

28         (4)  All selected schools shall receive financial

29  awards depending on the availability of funds appropriated and

30  the number and size of schools selected to receive an award.

31  Funds must be distributed to the school's fiscal agent and

 1  placed in the school's account and must be used for purposes

 2  listed in subsection (5) as determined jointly by the school's

 3  staff and school advisory council. If school staff and the

 4  school advisory council cannot reach agreement by November 1,

 5  half of the award must be used for the purposes listed in

 6  subsection (5) as determined by the school's staff and half of

 7  the award must be used for purposes listed in subsection (5)

 8  as determined by the school advisory council the awards must

 9  be equally distributed to all classroom teachers currently

10  teaching in the school.

11  

12  Notwithstanding statutory provisions to the contrary,

13  incentive awards are not subject to collective bargaining.

14         Section 3.  This act shall take effect upon becoming a

15  law.
