  2         An act relating to K-20 education

  3         accountability; amending s. 1008.31, F.S.;

  4         expanding legislative intent for the K-20

  5         education performance accountability system;

  6         providing requirements and an implementation

  7         schedule for performance-based funding;

  8         providing mission, goals, and measures;

  9         requiring collection of certain data; requiring

10         the State Board of Education to conduct a study

11         of equivalency scores for certain examinations

12         of certain students; authorizing the State

13         Board of Education to adopt certain equivalency

14         scores as meeting graduation requirements in

15         lieu of FCAT passing scores; defining eligible

16         students; providing for the use of certain

17         funds; providing an effective date.

19  Be It Enacted by the Legislature of the State of Florida:

20  

21         Section 1.  Section 1008.31, Florida Statutes, is

22  amended to read:

23         1008.31  Florida's K-20 education performance

24  accountability system; legislative intent; performance-based

25  funding; mission, goals, and systemwide measures.--

26         (1)  LEGISLATIVE INTENT.--It is the intent of the

27  Legislature that:

28         (a)  The performance accountability system implemented

29  to assess the effectiveness of Florida's seamless K-20

30  education delivery system provide answers to the following

31  questions in relation to its mission and goals:

 1         1.  What is the public receiving in return for funds it

 2  invests in education?

 3         2.  How effectively is Florida's K-20 education system

 4  educating its students?

 5         3.  How effectively are the major delivery sectors

 6  promoting student achievement?

 7         4.  How are individual schools and postsecondary

 8  education institutions performing their responsibility to

 9  educate their students as measured by how students are

10  performing and how much they are learning?

11         (b)  The K-20 education performance accountability

12  system be established as a single, unified accountability

13  system with multiple components, including, but not limited

14  to, measures of adequate yearly progress, individual student

15  learning gains, school grades, and return on investment.

16         (c)  The K-20 education performance accountability

17  system comply with the accountability requirements of the "No

18  Child Left Behind Act of 2001," PL 107-110.

19         (d)(b)  The State Board of Education recommend to the

20  Legislature systemwide performance standards; the Legislature

21  establish systemwide performance measures and standards; and

22  the systemwide measures and standards provide Floridians with

23  information on what the public is receiving in return for the

24  funds it invests in education and how well the K-20 system

25  educates its students.

26         (e)(c)  The State Board of Education establish

27  performance measures and set performance standards for

28  individual components of the public education system,

29  including individual schools and postsecondary educational

30  institutions, with measures and standards based primarily on

31  student achievement.

 1         (2)  PERFORMANCE-BASED FUNDING.--

 2         (a)  The State Board of Education shall cooperate with

 3  the Commissioner of Education and each delivery system to

 4  develop proposals for performance-based funding, using

 5  performance measures adopted pursuant to this section

 6  established by the Legislature.

 7         (b)  The State Board of Education proposals must

 8  provide that at least 10 percent of the state funds

 9  appropriated for the K-20 education system are conditional

10  upon meeting or exceeding established performance standards.

11  The State Board of Education must submit the recommendations

12  to the Legislature in the following sequence:

13         (a)  By December 1, 2002, recommendations for state

14  universities, for consideration by the 2003 Legislature and

15  implementation in the 2003-2004 fiscal year.

16         (b)  By December 1, 2003, recommendations for public

17  schools and workforce education, for consideration by the 2004

18  Legislature and implementation in the 2004-2005 fiscal year.

19         (c)  By December 1, 2004, recommendations for community

20  colleges, for consideration by the 2005 Legislature and

21  implementation in the 2005-2006 fiscal year.

22         (d)  By December 1, 2005, recommendations for all other

23  programs that receive state funds within the Department of

24  Education.

25         (c)  The State Board of Education shall adopt

26  guidelines required to implement performance-based funding

27  that allow 1 year to demonstrate achievement of specified

28  performance standards prior to a reduction in appropriations

29  pursuant to this section.

 1         (d)  By December 1, 2003, the State Board of Education

 2  shall adopt common definitions, measures, standards, and

 3  performance improvement targets required to:

 4         1.  Use the state core measures and the sector-specific

 5  measures to evaluate the progress of each sector of the

 6  educational delivery system toward meeting the systemwide

 7  goals for public education.

 8         2.  Notify the sectors of their progress in achieving

 9  the specified measures so that they may develop improvement

10  plans that directly influence decisions about policy, program

11  development, and management.

12         3.  Implement the performance-based budgeting system

13  described in this section.

14         (e)  During the 2003-2004 fiscal year, the Department

15  of Education shall collect data required to establish

16  progress, rewards, and sanctions.

17         (f)  By December 1, 2004, the Department of Education

18  shall recommend to the Legislature a formula for

19  performance-based funding that applies accountability

20  standards for the individual components of the public

21  education system at every level, kindergarten through graduate

22  school.  Effective for the 2004-2005 fiscal year and

23  thereafter, performance-based funds shall be allocated based

24  on the progress, rewards, and sanctions established pursuant

25  to this section.

26         (3)  MISSION, GOALS, AND SYSTEMWIDE MEASURES.--

27         (a)  The mission of Florida's K-20 education system

28  shall be to increase the proficiency of all students within

29  one seamless, efficient system, by allowing them the

30  opportunity to expand their knowledge and skills through

 1  learning opportunities and research valued by students,

 2  parents, and communities.

 3         (b)  The State Board of Education shall adopt guiding

 4  principles for establishing state and sector-specific

 5  standards and measures.

 6         (c)  The State Board of Education shall, and to

 7  maintain an accountability system that measures student

 8  progress toward the following goals:

 9         1.(a)  Highest student achievement, as measured by:

10  student FCAT performance and annual learning gains; the number

11  and percentage of schools that improve at least one school

12  performance grade designation or maintain a school performance

13  grade designation of "A" pursuant to s. 1008.34; graduation or

14  completion rates at all learning levels; and other measures

15  identified in law or rule.

16         2.(b)  Seamless articulation and maximum access, as

17  measured by: the percentage of students who demonstrate

18  readiness for the educational level they are entering, from

19  kindergarten through postsecondary education and into the

20  workforce; the number and percentage of students needing

21  remediation; the percentage of Floridians who complete

22  associate, baccalaureate, graduate, professional, and

23  postgraduate degrees; the number and percentage of credits

24  that articulate; the extent to which each set of exit-point

25  requirements matches the next set of entrance-point

26  requirements; the degree to which underserved populations

27  access educational opportunity; the extent to which access is

28  provided through innovative educational delivery strategies;

29  and other measures identified in law or rule.

30         3.(c)  Skilled workforce and economic development, as

31  measured by: the number and percentage of graduates employed

 1  in their areas of preparation; the percentage of Floridians

 2  with high school diplomas and postsecondary education

 3  credentials; the percentage of business and community members

 4  who find that Florida's graduates possess the skills they

 5  need; national rankings; and other measures identified in law

 6  or rule.

 7         4.(d)  Quality efficient services, as measured by: cost

 8  per completer or graduate; average cost per noncompleter at

 9  each educational level; cost disparity across institutions

10  offering the same degrees; the percentage of education

11  customers at each educational level who are satisfied with the

12  education provided; and other measures identified in law or

13  rule.

14         (4)  SYSTEMWIDE DATA COLLECTION.--School districts and

15  public postsecondary educational institutions shall maintain

16  information systems that will provide the State Board of

17  Education and the Legislature with information and reports

18  necessary to address the specifications of the accountability

19  system. The State Board of Education shall determine the

20  standards for the required data. The at a level of

21  comprehensiveness and quality shall be no less than that which

22  was available as of June 30, 2001.

23         Section 2.  The State Board of Education shall conduct

24  a concordance study to determine if crosswalk scores can be

25  determined to be equivalent to those required on the FCAT for

26  high school graduation. At a minimum, the State Board of

27  Education shall analyze the PSAT, PLAN, SAT, ACT, and the

28  College Placement Test to determine if equivalent scores can

29  be determined. In cases where such equivalences can be

30  determined, the State Board of Education may adopt those

31  scores as meeting the graduation requirement in lieu of the

 1  FCAT cut score. Each time the score is changed, new

 2  equivalences must be determined. The provision shall take

 3  effect for students who are eligible to graduate in the

 4  2002-2003 academic year, and the Department of Education may

 5  use unexpended Bright Futures/CLEP program funding for

 6  2002-2003 to ensure the study is completed in time to

 7  authorize graduation for students who may have received an

 8  equivalent score authorized under this section.

 9         Section 3.  This act shall take effect upon becoming a

10  law.

12          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
13                         Senate Bill 2296

14                                 

15  The committee substitute restores the Florida School
    Recognition Program to current law.
16  
    The committee substitute requires the State Board of Education
17  to conduct a study of equivalency scores for the PSAT, PLAN,
    SAT, ACT, and the College Placement Test. The committee
18  substitute authorizes the State Board of Education to adopt
    equivalency scores in lieu of FCAT passing scores for
19  graduation. The committee substitute provides that the
    equivalency determination applies to students who are eligible
20  to graduate in the 2002-2003 academic year. The committee
    substitute authorizes the Department of Education to use
21  unexpended Bright Futures-CLEP program funding for 2002-2003
    to complete the study and meet the authorized equivalency
22  requirements.
