1 A bill to be entitled
2 An act relating to powers and duties of
3 district school boards; amending s. 1001.43,
4 F.S.; authorizing district school board
5 programs and policies to provide for random
6 drug testing of high school student athletes;
7 providing an effective date.

9 WHEREAS, the State of Florida considers providing a
10 quality education to its children the highest of priorities,
11 and
12 WHEREAS, athletic competition is an integral part of
13 the educational process, providing personal challenges and
14 responsibility, skill in competition, teamwork cultivation,
15 and school pride, and
16 WHEREAS, the State of Florida has a compelling interest
17 in ensuring that children are educated and compete in a safe
18 and healthy environment, and
19 WHEREAS, the use of illicit drugs, performance
20 enhancing drugs, and certain prescription drugs is considered
21 a health and safety threat within Florida s schools,
22 playgrounds, and athletic fields and forums, and
23 WHEREAS, studies and pilot projects have found a
24 significant curtailment of drug use among student athletes who
25 are subject to random drug testing, NOW, THEREFORE,

27 Be It Enacted by the Legislature of the State of Florida:

29 Section 1. Subsection (1) of section 1001.43, Florida
30 Statutes, is amended to read:

1 1001.43 Supplemental powers and duties of district
2 school board.--The district school board may exercise the
3 following supplemental powers and duties as authorized by this
4 code or State Board of Education rule.
5 (1) STUDENT MANAGEMENT.--The district school board may
6 adopt programs and policies to ensure the safety and welfare
7 of individuals, the student body, and school personnel, which
8 programs and policies may:
9 (a) Prohibit the possession of weapons and drugs on
10 campus, student hazing, and other activities that could
11 threaten the operation of the school or the safety and welfare
12 of the student body or school personnel.
13 (b) Permit random drug testing of high school student
14 athletes.
15 (c)(b) Require uniforms to be worn by the student
16 body, or impose other dress-related requirements, if the
17 district school board finds that those requirements are
18 necessary for the safety or welfare of the student body or
19 school personnel.
20 (d)(c) Provide procedures for student dismissal
21 precautions and for granting permission for students to leave
22 school grounds during school hours, including releasing a
23 student from school upon request by a parent or for public
24 appearances of school groups.
25 (e)(d) Provide procedures for managing protests,
26 demonstrations, sit-ins, walk-outs, or other acts of civil
27 disobedience.
28 (f)(e) Provide procedures for detaining students and
29 for readmission of students after expulsion.
30 (g)(f) Regulate student automobile use and parking.
31 Section 2. This act shall take effect July 1, 2003.
