An act relating to instructional materials for K-12 public |

education; authorizing the Department of Education to |

conduct a pilot program; authorizing a pilot program |
|

within specified counties to enable selected school |
|

|
districts to realize cost savings in the purchase of used |
|
7
|
instructional materials; imposing requirements on the |
|
8
|
vendors of such materials; absolving the state from |
|
9
|
responsibility for certain financial losses; requiring the |
|
10
|
Council for Education Policy Research and Improvement to |
|
11
|
report to the Legislature; providing for future repeal; |
|
12
|
providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

|
Section 1. Notwithstanding the provisions of s. 1006.37, |
|
17
|
Florida Statutes, the Department of Education may conduct a |
|
18
|
pilot program to enable selected school districts to realize |
|
19
|
cost savings without loss of quality or availability for |
|
20
|
individual students in the purchase of used instructional |
|
21
|
materials. The school districts of Hernando County, Pasco |
|
22
|
County, and Polk County may participate in the pilot program. |
|
23
|
Charter schools in such school districts shall be eligible to |
|
24
|
participate in the pilot program. When a secondhand book dealer |
|
25
|
or other third-party book vendor provides used adopted |
|
26
|
instructional materials to a school district, the dealer or |
|
27
|
vendor must certify the availability of the used instructional |
|
28
|
materials, provide the International Standard Book Number of |
|
29
|
each of the used instructional materials, and certify that such |
|
30
|
materials are not samples or first printings, are the most |
|
31
|
currently adopted, Florida-specific instructional materials, and |
|
32
|
conform to the Sunshine State Standards. The state is not |
|
33
|
responsible for financial loss caused by the school district’s |
|
34
|
deviating from the requirements of s. 1006.37, Florida Statutes. |
|

|
The Council for Education Policy Research and Improvement shall |
|
36
|
submit to the President of the Senate and the Speaker of the |
|
37
|
House of Representatives for consideration during the 2004 |
|
38
|
Regular Session a report of the cost savings to school districts |
|
39
|
based on results of the pilot program. This section is repealed |
|
40
|
July 1, 2006.

Section 2. This act shall take effect July 1, 2003. |
