11  Senator Peaden moved the following amendment:
12  
13         Senate Amendment 
14         On page 44, between lines 28 and 29,
15  
16  insert:  
17         (d)  "Primary wholesaler" means any wholesale
18  distributor that:
19         1.  Purchased 90 percent or more of the total dollar
20  volume of its purchases of prescription drugs directly from
21  manufacturers in the previous year; and
22         2.a.  Directly purchased prescription drugs from not
23  fewer than 50 different prescription drug manufacturers in the
24  previous year; or
25         b.  Has, or the affiliated group, as defined in s. 1504
26  of the Internal Revenue Code, of which the wholesale
27  distributor is a member has, not fewer than 250 employees.
28         (e)  "Directly from a manufacturer" means:
29         1.  Purchases made by the wholesale distributor
30  directly from the manufacturer of prescription drugs; and
31         2.  Transfers from a member of an affiliated group, as

 1  defined in s. 1504 of the Internal Revenue Code, of which the
 2  wholesale distributor is a member, if:
 3         a.  The affiliated group purchases 90 percent or more
 4  of the total dollar volume of its purchases of prescription
 5  drugs from the manufacturer in the previous year; and
 6         b.  The wholesale distributor discloses to the
 7  department the names of all members of the affiliated group of
 8  which the wholesale distributor is a member and the affiliated
 9  group agrees in writing to provide records on prescription
10  drug purchases by the members of the affiliated group not
11  later than 48 hours after the department requests access to
12  such records, regardless of the location where the records are
13  stored.
14         (f)  "Secondary wholesaler" means a wholesale
15  distributor that is not a primary wholesaler.
