3 Achievement Improvement Trust Fund Matching
4 Grants; amending s. 1011.765, F.S.; providing
5 for the use of such funds for classroom
6 support; revising the means of allocating such
7 funds; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Section 1011.765, Florida Statutes, is
12 amended to read:
13 1011.765 Florida Academic Improvement Trust Fund
14 matching grants.--
15 (1) MATCHING GRANTS.--The Florida Academic Improvement
16 Trust Fund shall be utilized to provide matching grants to the
17 Florida School for the Deaf and the Blind Endowment Fund and
18 to any public school district education foundation that meets
19 the requirements of this section and is recognized by the
20 local school district as its designated K-12 education
21 foundation.
22 (a) The State Board of Education shall adopt rules for
23 the administration, submission, documentation, evaluation, and
24 approval of requests for matching funds and for maintaining
25 accountability for matching funds.
26 (b) Donations, state matching funds, or proceeds from
27 endowments established pursuant to this section shall be used
28 at the discretion of the public school district education
29 foundation or the Florida School for the Deaf and the Blind
30 for academic achievement and classroom support within the
31 school district or school, and shall not be expended for the

1 construction of facilities or for the support of
2 interscholastic athletics. No public school district education
3 foundation or the Florida School for the Deaf and the Blind
4 shall accept or purchase facilities for which the state will
5 be asked for operating funds unless the Legislature has
6 granted prior approval for such acquisition.
7 (2) ALLOCATION OF THE TRUST FUND.--Funds appropriated
8 to the Florida Academic Improvement Trust Fund shall be
9 allocated by the Consortium of Florida Education Foundations
10 Department of Education in the following manner:
11 (a) For every year in which there is a legislative
12 appropriation to the trust fund, 1 percent an equal amount of
13 the annual appropriation shall be allocated by match to each
14 of, to be determined by dividing the total legislative
15 appropriation by the number of local education foundations as
16 well as the Florida School for the Deaf and the Blind, with
17 any remaining funds distributed by unweighted FTE must be
18 reserved for each public school district education foundation
19 and the Florida School for the Deaf and the Blind Endowment
20 Fund to provide each foundation and the Florida School for the
21 Deaf and the Blind with an opportunity to receive and match
22 appropriated funds. Trust funds that remain unmatched by
23 contribution by January 15 on April 1 of any year shall be
24 made available for matching by any public school district
25 education foundation and by the Florida School for the Deaf
26 and the Blind which shall have an opportunity to apply for
27 excess trust funds prior to the award of such funds.
28 (b) Matching grants shall be proportionately allocated
29 from the trust fund on the basis of matching each $1 $4 of
30 state funds with $1 $6 of private funds. To be eligible for

1 matching, a minimum of $2,500 $4,500 must be raised from
2 private sources.
3 (c) Funds sufficient to provide the match shall be
4 transferred from the state trust fund to the Consortium of
5 Florida Education Foundations public school education
6 foundation or to the Florida School for the Deaf and the Blind
7 Endowment Fund upon certification notification that a
8 proportionate amount has been received and deposited by the
9 individual foundation or the Florida School for the Deaf and
10 the Blind school into its own trust fund.
11 (d) If the total of the amounts to be distributed in
12 any quarter pursuant to this subsection exceeds the amount of
13 funds remaining from specific appropriations made for the
14 implementation of this section, all grants shall be
15 proportionately reduced so that the total of matching grants
16 distributed does not exceed available appropriations.
17 (3) GRANT ADMINISTRATION.--
18 (a) Each public school district education foundation
19 and the Florida School for the Deaf and the Blind
20 participating in the Florida Academic Improvement Trust Fund
21 shall separately account for all funds received pursuant to
22 this section, and may establish its own academic improvement
23 trust fund as a depository for the private contributions,
24 state matching funds, and earnings on investments of such
25 funds. State matching funds shall be administered through the
26 Consortium of Florida Education Foundations, transferred to
27 the public school district education foundation or to the
28 Florida School for the Deaf and the Blind Endowment Fund upon
29 certification notification that the foundation or school has
30 received and deposited private contributions that meet the
31 criteria for matching as provided in this section. The public

1 school district education foundations and the Florida School
2 for the Deaf and the Blind are responsible for the
3 maintenance, investment, and administration of their academic
4 improvement trust funds.
5 (b) The public school district education foundations
6 and the Florida School for the Deaf and the Blind shall be
7 responsible for soliciting and receiving contributions to be
8 deposited and matched with grants for academic achievement
9 within the school district or school.
10 (c) Each public school district education foundation
11 and the Florida School for the Deaf and the Blind shall be
12 responsible for proper expenditure of the funds received
13 pursuant to this section.
14 Section 2. This act shall take effect July 1, 2003.
