1 A bill to be entitled
2 An act relating to physical fitness; creating
3 the Governor's Council on Physical Fitness and
4 Health; providing membership; allowing
5 compensation for per diem and travel expenses;
6 providing for meetings; defining a quorum;
7 providing powers and duties; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Governor's Council on Physical Fitness and
13 Health; creation; membership; meetings; quorum; compensation;
14 powers and duties.--
15 (1) There is created the Governor's Council on
16 Physical Fitness and Health in the Department of Health.
17 (2) The Governor's Council on Physical Fitness and
18 Health shall consist of 10 members, including a chairperson.
19 Members of the council shall include:
20 (a) One member of the Senate appointed by the
21 President Pro Tempore of the Senate;
22 (b) One member of the House of Representatives
23 appointed by the Speaker of the House of Representatives;
24 (c) Eight members, appointed by the Governor and
25 serving at the pleasure of the Governor, who are in the
26 healthcare professions, the fields of business and industry,
27 physical education, recreation, sports, and the general
28 public.
29 (3) Of the eight initial nonlegislative members of the
30 council, two shall be appointed for a term of 1 year; two for
31 a term of 2 years; two for a term of 3 years; and two for a

1 term of 4 years. At the end of the respective terms of office
2 of the initial members, each nonlegislative member shall be
3 appointed for a term of 4 years. A nonlegislative member may
4 not serve more than two consecutive 4-year terms. If a member
5 does not complete his or her term due to resignation, death,
6 disability, removal, or refusal to serve, the Governor shall
7 appoint a qualified person to serve for the remainder of the
8 unexpired term.
9 (4) Legislative members of the council shall be
10 appointed to serve 2-year terms that begin and end on July 1
11 of odd-numbered years. A legislative member of the council may
12 not serve more than two consecutive terms.
13 (5) Members of the Governor's Council on Physical
14 Fitness and Health are entitled to receive per diem and
15 necessary travel expenses as set forth in section 112.061,
16 Florida Statutes.
17 (6) The council shall meet no more than quarterly.
18 (7) A majority of the council constitutes a quorum for
19 transacting business.
20 (8) The Governor's Council on Physical Fitness and
21 Health has the following powers and duties:
22 (a) To promote interest in physical fitness; to
23 consider the need for new state programs in the field of
24 physical fitness; and to enlist the active support of
25 individual residents of this state, professional and civic
26 groups, amateur and professional athletes, voluntary
27 organizations, state and local government agencies, private
28 industry and business, and community recreation programs in
29 efforts to improve the physical fitness and the health of the
30 residents of this state.

1 (b) To examine current programs of physical fitness
2 which are available to the residents of this state and to make
3 recommendations to the Governor for the coordination of
4 programs to prevent duplication of such services; to support
5 programs of physical fitness in the public school systems; to
6 develop cooperative programs with medical, dental, and other
7 groups; to maintain a liaison with governmental, private, and
8 other agencies concerning physical fitness programs; to
9 stimulate research in the area of physical fitness; and to
10 sponsor physical fitness workshops, clinics, conferences, and
11 other related activities pertaining to physical fitness
12 throughout the state.
13 (c) To serve as an agency for recognizing outstanding
14 developments, contributions, and achievements in physical
15 fitness in this state.
16 (d) To serve as the Florida sanctioning body for
17 competitive athletic events for which sanctioning by the state
18 is required.
19 (e) To submit to the Governor and to the Secretary of
20 Health an annual report that includes suggestions and
21 recommendations for the furtherance of the physical fitness of
22 the residents of this state.
23 Section 2. This act shall take effect July 1, 2003.
