2 An act relating to the Governor's Council for a
3 Fit Florida; amending s. 288.1229, F.S.;
4 providing for creation and placement of
5 council; providing for powers and duties,
6 membership and terms thereof; providing for
7 reimbursement for per diem and travel expenses
8 for members of the council; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (10) is added to section
14 288.1229, Florida Statutes, to read:
15 288.1229 Promotion and development of sports-related
16 industries and amateur athletics; direct-support organization;
17 powers and duties.--
18 (10)(a) There is hereby created the Governor's
19 Advisory Council for a Fit Florida within the direct support
20 organization for the purpose of serving as an advisory body to
21 the direct support organization to provide insight and
22 expertise relating to physical fitness and nutrition in the
23 state. In order to accomplish this purpose, the council shall
24 do the following:
25 1. Advise the direct support organization on ways to
26 promote interest in the area of physical fitness and nutrition
27 and to provide assistance in such promotion;
28 2. Examine current physical fitness and nutrition
29 programs available to the people of this state and recommend
30 to the direct support organization any coordination of
31 programs needed to prevent duplication of services.

1 3. Recommend ways in which the direct support
2 organization could promote and support physical fitness
3 programs in the public school system, including consideration
4 of such things as appropriate levels of physical activity and
5 proper levels of nutrition;
6 4. Advise the direct support organization on the need
7 for new programs in the field of physical fitness and
8 nutrition;
9 5. Assist the direct support organization in enlisting
10 the active support of a Fit Florida Alliance comprised of
11 individual citizens, professional and civic groups, amateur
12 and professional athletes, voluntary organizations, state and
13 local government agencies, private industry and business, and
14 community recreation programs in efforts to improve the
15 physical fitness and the health of the citizens of this state;
16 6. Make recommendations to the direct support
17 organization on appointments to a Fit Florida Alliance.
18 7. Make recommendations to the direct support
19 organization on recognition programs for schools and
20 communities participating in physical fitness and nutrition
21 efforts; on sponsorship of physical fitness workshops,
22 clinics, conferences, and other related activities; on liaison
23 efforts with government, private, and other agencies
24 concerning physical fitness and nutrition programs; on the
25 need for dissemination of information regarding physical
26 fitness and nutrition programs, including the type of
27 information, the target audience, and the method of
28 dissemination; and on the participation of governments,
29 individuals, organizations, and business entities in program
30 development and support and funding of initiatives related to

1 physical fitness and nutrition efforts recommended by the
2 council and initiated by the direct support organization.
3 8. Provide an annual report to the Governor, the
4 Office of Tourism, Trade, and Economic Development, and the
5 direct support organization that shall include recommendations
6 for the furtherance of the physical fitness of the people of
7 this state.
8 (b)1. The council shall consist of 10 members, eight
9 to be appointed by the Governor, one to be appointed by the
10 President of the Senate, and one to be appointed by the
11 Speaker of the House of Representatives, with the initial
12 appointments being made no later than September 2003.
13 2. When making appointments to the council the
14 Governor, the President of the Senate, and the Speaker of the
15 House of Representatives shall appoint persons from the health
16 care professions, the fields of business and industry,
17 physical education, recreation, sports, and the general
18 public. Members of the council appointed by the Governor shall
19 serve at the pleasure of the Governor.
20 3. The council members appointed by the President of
21 the Senate and the Speaker of the House of Representatives
22 shall serve for a term of 2 years beginning and ending on July
23 1 of odd-numbered years, and shall serve no more than two
24 consecutive terms. These appointees serve at the pleasure of
25 the official who appointed the member of the council.
26 4. The eight initial members appointed by the Governor
27 shall be appointed as follows: two for a term of 1 year, two
28 for a term of 2 years, two for a term of 3 years, and two for
29 a term of 4 years. At the end of the respective terms of
30 office of the initial members, all succeeding appointments

1 shall be for terms of 4 years. Members shall serve no more
2 than two consecutive 4-year terms.
3 5. All unexpired terms due to vacancy shall be filled
4 by the official who appointed the council member.
5 6. The council shall annually elect from the
6 membership one member to serve as chair of the council and one
7 member to serve as vice chair.
8 7. The council shall meet no more than quarterly and a
9 majority of the council shall constitute a quorum for the
10 transaction of business.
11 8. Members of the council shall receive no
12 compensation but shall receive reimbursement for per diem and
13 travel expenses as provided in s. 112.061, Florida Statutes,
14 while in the performance of their duties.
15 (b) This subsection is repealed on July 1, 2008.
16 Section 2. This act shall take effect upon becoming a
17 law.

22 The Committee Substitute creates the Governor's Advisory
Council for a Fit Florida consisting of ten members to advise
23 and make recommendations to the direct support organization of
the Office of Tourism, Trade, and Economic Development, on
24 ways to promote interest in the area of physical fitness and
nutrition and to provide assistance in such promotion. The
25 Committee Substitute revises conditions of appointment to the
advisory council and subjects the provisions creating the
26 council to repeal on July 1, 2008.
