| 3 | surcharges; creating s. 212.035, F.S.; authorizing certain | ||
| 4 | municipalities to impose and collect a surcharge on | ||
| 5 | certain parking facility space sale, lease, or rental | ||
| 6 | charges; requiring referendum approval; providing for a | ||
| 7 | maximum surcharge rate; specifying uses and limits of | ||
| 8 | surcharge proceeds; providing an effective date. | ||

| 10 | Be It Enacted by the Legislature of the State of Florida: | ||
| 11 | |||
| 12 | Section 1. Section 212.035, Florida Statutes, is created | ||
| 13 | to read: | ||
| 14 | 212.035 Surcharge on municipal facility parking fees.-- | ||
| 15 | (1) The governing authority of any municipality with a | ||
| 16 | resident population of 200,000 or more, more than 20 percent of | ||
| 17 | the real property of which is exempt from ad valorem taxes, and | ||
| 18 | which is located in a county with a population of more than | ||
| 19 | 500,000 may impose and collect, subject to referendum approval | ||
| 20 | by voters in the municipality, a discretionary per-vehicle | ||
| 21 | surcharge of up to 20 percent of the amount charged for the | ||
| 22 | sale, lease, or rental of space at parking facilities within the | ||
| 23 | municipality that are open for use to the general public. | ||
| 24 | (2) A municipal governing authority that imposes the | ||
| 25 | surcharge authorized by this subsection may use the proceeds of | ||
| 26 | such surcharge for the following purposes only: | ||
| 27 | (a) No less than 60 percent and no more than 80 percent of | ||
| 28 | surcharge proceeds shall be used to reduce the municipality’s ad | ||
| 29 | valorem tax millage or to reduce or eliminate non-ad valorem | ||
| 30 | assessments. | ||
| 31 | (b) Not more than 40 percent and not less than 20 percent | ||
| 32 | of surcharge proceeds shall be used to improve transportation | ||
| 33 | including, but not limited to, street, sidewalk, roadway, | ||
| 34 | landscape, transit, and streetscape beautification improvements. | ||
| 35 | Section 2. This act shall take effect upon becoming a law. | ||
