1 A bill to be entitled
2 An act relating to educational facilities;
3 amending s. 1013.64, F.S.; providing that funds
4 from the Public Education Capital Outlay and
5 Debt Services Trust Fund may be used for the
6 purposes of constructing and insuring
7 educational facilities, including new
8 construction; requiring districts to compare
9 certain life-cycle costs of materials used in
10 constructing or expanding educational
11 facilities; providing for retroactive
12 application; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Paragraph (b) of subsection (1) of section
17 1013.64, Florida Statutes, is amended to read:
18 1013.64 Funds for comprehensive educational plant
19 needs; construction cost maximums for school district capital
20 projects.--Allocations from the Public Education Capital
21 Outlay and Debt Service Trust Fund to the various boards for
22 capital outlay projects shall be determined as follows:
23 (1)
24 (b) Each board is prohibited from using the funds
25 received pursuant to this section to supplant funds in the
26 current fiscal year approved operating budget, except that
27 funds received under this section may be used for ancillary
28 plants, auxiliary facilities, core facilities, educational
29 facilities, educational plants, low-energy usage features, new
30 construction, passive design elements, and projects, sites,
31 and satellite facilities funded from public education capital

1 outlay moneys and to insure the same. and All budgeted funds
2 shall be expended at a rate not less than would have been
3 expended had the funds under this section not been received.
4 Section 2. (1) In order to ensure that the
5 construction of new and expanded education facilities provides
6 the best long-term value, school districts shall compare the
7 following life-cycle costs of materials used by competing
8 providers when constructing or expanding school capacity:
9 (a) The anticipated annual energy consumption;
10 (b) The relative resistance to damage by wind loads
11 and associated debris;
12 (c) The resistance to wood destroying organisms;
13 (d) The perpetual maintenance costs;
14 (e) The resistance to fire; and
15 (f) A comparison of the annual insurance costs.
16 (2) School districts may rely on the information
17 provided by contractors if the analysis is based on the best
18 currently available methods, including those of the National
19 Institute of Standards and Technology, the Department of
20 Housing and Urban Development, and other federal and state
21 agencies and technical or professional societies.
22 Section 3. This act shall take effect upon becoming a
23 law and shall apply retroactively to the beginning of the
24 current fiscal year.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 Senate Bill 2370

4 The Committee Substitute adds the payment of insurance as an
eligible expenditure from specified Public Education Capital
5 Outlay and Debt Service funds received by a school district.
6 The Committee Substitute includes a new section which requires
school districts to compare the life-cycle costs of specific
7 construction materials when constructing or expanding school
capacity.
