1 A bill to be entitled
2 An act relating to environmental protection;
3 providing a popular name; providing for
4 remediation of contaminated sites in counties
5 and municipalities; authorizing the Department
6 of Environmental Protection to adopt rules and
7 issue orders; providing for enforcement;
8 providing for control in the event of conflict
9 of provisions; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. This act shall be known by the popular name
14 the "Public Resource Protection Act."
15 Section 2. Counties and municipalities that own sites
16 with soil or water contamination shall remediate such sites to
17 the same extent as is required for brownfield sites under
18 section 376.81, Florida Statutes.
19 Section 3. The Department of Environmental Protection
20 may adopt such rules and issue such orders as may be necessary
21 to carry out the provisions of this act.
22 Section 4. The provisions of this act may be enforced
23 pursuant to sections 120.69, 120.695, 376.83, 403.141,
24 403.161, and 403.412, Florida Statutes.
25 Section 5. If any provision of this act or of the
26 rules adopted pursuant to this act is in conflict with any
27 other provision, limitation, or restriction which is now in
28 effect under any law of this state or any ordinance of a local
29 government, political subdivision, or municipality, or any
30 rule or regulation adopted thereunder, the provisions of this
31 act or of the rules adopted pursuant to this act shall

1 control; provided, however, that a local government, political
2 subdivision, or municipality is not prohibited from adopting
3 and enforcing more stringent provisions.
4 Section 6. This act shall take effect upon becoming a
5 law.
