  1                      A bill to be entitled

  2         An act relating to the Department of Highway

  3         Safety and Motor Vehicles; amending s. 322.27,

  4         F.S.; requiring law enforcement agencies to

  5         notify the department of the issuance of

  6         citations or arrests for offenses that require

  7         mandatory revocation of license upon

  8         conviction; providing an effective date.

  9  

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (1) of section 322.27, Florida

13  Statutes, is amended to read:

14         322.27  Authority of department to suspend or revoke

15  license.--

16         (1)  Notwithstanding any provisions to the contrary in

17  chapter 120, the department is hereby authorized to suspend

18  the license of any person without preliminary hearing upon a

19  showing of its records or other sufficient evidence that the

20  licensee:

21         (a)  Has committed an offense for which mandatory

22  revocation of license is required upon conviction. A law

23  enforcement agency must notify the department when any of its

24  officers issues a citation or makes an arrest for an offense

25  covered by this paragraph;

26         (b)  Has been convicted of a violation of any traffic

27  law which resulted in a crash that caused the death or

28  personal injury of another or property damage in excess of

29  $500;

30         (c)  Is incompetent to drive a motor vehicle;

 1         (d)  Has permitted an unlawful or fraudulent use of

 2  such license or has knowingly been a party to the obtaining of

 3  a license by fraud or misrepresentation or to display, or

 4  represent as one's own, any driver's license not issued him or

 5  her.  Provided, however, no provision of this section shall be

 6  construed to include the provisions of s. 322.32(1);

 7         (e)  Has committed an offense in another state which if

 8  committed in this state would be grounds for suspension or

 9  revocation; or

10         (f)  Has committed a second or subsequent violation of

11  s. 316.172(1) within a 5-year period of any previous

12  violation.

13         Section 2.  This act shall take effect July 1, 2003.

16                          SENATE SUMMARY

17    Requires law enforcement agencies to notify the
      Department of Highway Safety and Motor Vehicles when
18    their officers issue citations or make arrests for
      offenses for which mandatory license revocation upon
19    conviction is required.
