1 A bill to be entitled
2 An act relating to the Department of Highway
3 Safety and Motor Vehicles; amending s. 322.27,
4 F.S.; requiring law enforcement agencies to
5 notify the department of any traffic fatality
6 or the commission of an offense that requires
7 mandatory revocation of license upon
8 conviction; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsection (1) of section 322.27, Florida
13 Statutes, is amended to read:
14 322.27 Authority of department to suspend or revoke
15 license.--
16 (1) Notwithstanding any provisions to the contrary in
17 chapter 120, the department is hereby authorized to suspend
18 the license of any person without preliminary hearing upon a
19 showing of its records or other sufficient evidence that the
20 licensee:
21 (a) Has committed an offense for which mandatory
22 revocation of license is required upon conviction. A law
23 enforcement agency must provide information to the department
24 within 24 hours after any traffic fatality or the commission
25 of an offense for which mandatory revocation of license upon
26 conviction is required;
27 (b) Has been convicted of a violation of any traffic
28 law which resulted in a crash that caused the death or
29 personal injury of another or property damage in excess of
30 $500;
31 (c) Is incompetent to drive a motor vehicle;

1 (d) Has permitted an unlawful or fraudulent use of
2 such license or has knowingly been a party to the obtaining of
3 a license by fraud or misrepresentation or to display, or
4 represent as one's own, any driver's license not issued him or
5 her. Provided, however, no provision of this section shall be
6 construed to include the provisions of s. 322.32(1);
7 (e) Has committed an offense in another state which if
8 committed in this state would be grounds for suspension or
9 revocation; or
10 (f) Has committed a second or subsequent violation of
11 s. 316.172(1) within a 5-year period of any previous
12 violation.
13 Section 2. This act shall take effect July 1, 2003.

18 The CS provides a law enforcement agency must provide
information to the Department of Highway Safety and Motor
19 Vehicles within 24 hours after any traffic fatality or the
commission of an offense for which mandatory revocation of
20 license upon conviction is required.
