1 A bill to be entitled
2 An act relating to driving under the influence;
3 amending s. 316.193, F.S.; requiring the
4 arresting law enforcement agency to impound a
5 vehicle used in committing an offense of
6 driving under the influence for a specified
7 period; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (9) of section 316.193, Florida
12 Statutes, is amended to read:
13 316.193 Driving under the influence; penalties.--
14 (9)(a) A person who is arrested for a violation of
15 this section may not be released from custody:
16 1.(a) Until the person is no longer under the
17 influence of alcoholic beverages, any chemical substance set
18 forth in s. 877.111, or any substance controlled under chapter
19 893 and affected to the extent that his or her normal
20 faculties are impaired;
21 2.(b) Until the person's blood-alcohol level or
22 breath-alcohol level is less than 0.05; or
23 3.(c) Until 8 hours have elapsed from the time the
24 person was arrested.
25 (b) In addition to the requirements of paragraph (a),
26 the arresting law enforcement agency shall impound for 24
27 hours a motor vehicle that is used in a violation of this
28 section.
29 Section 2. This act shall take effect July 1, 2003.
