1 A bill to be entitled
2         An act relating to the Florida Kidcare program; creating
3   s. 409.8141, F.S.; providing that an uninsured parent,
4   guardian, or relative caretaker of a child enrolled in the
5   Florida Kidcare program is eligible for coverage under the
6   program, subject to certain limitation; requiring separate
7   premiums or cost-sharing requirements for the parent,
8   guardian, or relative caretaker; providing that nonpayment
9   of premiums or cost-sharing requirements for an adult is
10   not grounds for disenrolling a child in that family from
11   the program; providing for coverage of a parent, guardian,
12   or relative caretaker whose income is above a specified
13   level if the adult pays the full cost of the premium,
14   including administrative costs; providing that the
15   eligibility for coverage provided by the act is not an
16   entitlement; authorizing the Agency for Health Care
17   Administration and the board of directors of the Florida
18   Healthy Kids Corporation to limit enrollment under the
19   act; exempting the adults enrolled under the act from the
20   enrollment limitations of the Florida Kidcare program;
21   providing an effective date.

23         Be It Enacted by the Legislature of the State of Florida:
24         
25         Section 1. Section 409.8141, Florida Statutes, is created
26   to read:
27         409.8141 Eligibility for a parent, guardian, or relative
28   caretaker.--
29         (1) An uninsured parent, guardian, or relative caretaker
30   of a child enrolled in the Florida Kidcare program is eligible
31   for coverage under the Florida Kidcare program, subject to the
32   availability of moneys and any limitations established in the
33   General Appropriations Act or chapter 216.
34         (2) Cost-sharing requirements or premiums charged for
35   coverage for a parent, guardian, or relative caretaker shall be
36   separate from and in addition to the cost-sharing provisions
37   imposed for child coverage. Nonpayment of the premiums or cost-
38   sharing requirements for a parent, guardian, or relative
39   caretaker shall not be grounds for disenrollment of a child in
40   that family.
41         (3) A parent, guardian, or relative caretaker of a child
42   enrolled in the Florida Kidcare program whose income is above
43   200 percent of the federal poverty level may participate in the
44   Florida Kidcare program; however, the adult is not eligible for
45   premium assistance payments and must pay the full cost of the
46   premium, including any administrative costs.
47         (4) The eligibility created in this section is not an
48   entitlement. The agency and the board of directors of the
49   Florida Healthy Kids Corporation may place limits on enrollment
50   of parents, guardians, or relative caretakers in order to avoid
51   adverse selection or to comply with limitations in the General
52   Appropriations Act.
53         (5) A parent, guardian, or relative caretaker who
54   participates in the Florida Kidcare program as provided in this
55   section is not included in the annual limitations on enrollment
56   established for the Florida Kidcare program.
57         Section 2. This act shall take effect October 1, 2003.
