11  The Committee on Banking and Insurance recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 1, line 12,
16  
17  insert:  
18         Section 2.  Section 624.105, F.S., is created to read:
19         624.105  Waiver of customer liability; insurance
20  required.--Any entity defined in s. 364.02(12), s. 366.02, s.
21  367.011, or s. 367.022(2) and (7) may charge for and include
22  an optional waiver of liability provision in their customer
23  contracts at the election of the customer under which the
24  entity agrees to waive all or a portion of the customer's
25  liability for service from the entity for a defined period in
26  the event of the customer's death, disability, call to active
27  military service, involuntary unemployment, qualification for
28  family leave, or similar qualifying event or condition. No
29  such provision shall constitute insurance so long as:
30         (1)  the provision is a contract between the entity and
31  its customer; and

 1         (2)  the entity secures insurance from an insurer
 2  authorized to do business in this state to guarantee its
 3  contractual obligations under the provision.

19         contracts; providing that such provisions do
