  1                      A bill to be entitled

  2         An act relating to the Fair Housing Act;

  3         amending s. 760.22, F.S.; defining the term

  4         "source of income"; amending s. 760.23, F.S.;

  5         prohibiting discrimination in the sale or

  6         rental of housing because of a person's source

  7         of income; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Present subsections (9) and (10) of section

12  760.22, Florida Statutes, are redesignating as subsections

13  (10) and (11), respectively, and a new subsection (9) is added

14  to that section, to read:

15         760.22  Definitions.--As used in ss. 760.20-760.37, the

16  term:

17         (9)  "Source of income" means receipt of any federal,

18  state, or local assistance, including medical assistance or

19  rent supplements.

20         Section 2.  Subsections (1), (2), (3), (4), and (5) of

21  section 760.23, Florida Statutes, are amended to read:

22         760.23  Discrimination in the sale or rental of housing

23  and other prohibited practices.--

24         (1)  It is unlawful to refuse to sell or rent after the

25  making of a bona fide offer, to refuse to negotiate for the

26  sale or rental of, or otherwise to make unavailable or deny a

27  dwelling to any person because of race, color, national

28  origin, sex, handicap, familial status, or religion, or source

29  of income.

30         (2)  It is unlawful to discriminate against any person

31  in the terms, conditions, or privileges of sale or rental of a

 1  dwelling, or in the provision of services or facilities in

 2  connection therewith, because of race, color, national origin,

 3  sex, handicap, familial status, or religion, or source of

 4  income.

 5         (3)  It is unlawful to make, print, or publish, or

 6  cause to be made, printed, or published, any notice,

 7  statement, or advertisement with respect to the sale or rental

 8  of a dwelling that indicates any preference, limitation, or

 9  discrimination based on race, color, national origin, sex,

10  handicap, familial status, or religion, or source of income or

11  an intention to make any such preference, limitation, or

12  discrimination.

13         (4)  It is unlawful to represent to any person because

14  of race, color, national origin, sex, handicap, familial

15  status, or religion, or source of income that any dwelling is

16  not available for inspection, sale, or rental when such

17  dwelling is in fact so available.

18         (5)  It is unlawful, for profit, to induce or attempt

19  to induce any person to sell or rent any dwelling by a

20  representation regarding the entry or prospective entry into

21  the neighborhood of a person or persons of a particular race,

22  color, national origin, sex, handicap, familial status, or

23  religion, or source of income.

24         Section 3.  This act shall take effect upon becoming a

25  law.

28                          SENATE SUMMARY

29    Defines the term "source of income" for purposes of the
      Fair Housing Act. Prohibits discrimination based upon a
30    person's source of income.
