  2         An act relating to alimony; amending s. 61.08,

  3         F.S.; requiring that alimony terminate if the

  4         recipient enters into a live-in relationship

  5         with another person; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (1) of section 61.08, Florida

11  Statutes, is amended to read:

12         61.08  Alimony.--

13         (1)(a)  In a proceeding for dissolution of marriage,

14  the court may grant alimony to either party, which alimony may

15  be rehabilitative or permanent in nature. In any award of

16  alimony, the court may order periodic payments or payments in

17  lump sum or both. The court may consider the adultery of

18  either spouse and the circumstances thereof in determining the

19  amount of alimony, if any, to be awarded.  In all dissolution

20  actions, the court shall include findings of fact relative to

21  the factors enumerated in subsection (2) supporting an award

22  or denial of alimony.

23         (b)  The court shall terminate any right to alimony

24  upon proof that the recipient of the alimony is in a live-in

25  relationship with another person.

26         Section 2.  This act shall take effect July 1, 2003.
