  1                      A bill to be entitled

  2         An act relating to the Florida Free Gift

  3         Advertising Law; amending s. 817.415, F.S.;

  4         requiring persons who offer free merchandise to

  5         charge the consumer who accepts such offer no

  6         more for shipping and handling than the actual

  7         cost incurred by the shipper; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (5) of section 817.415, Florida

13  Statutes, is amended to read:

14         817.415  Florida Free Gift Advertising Law.--

15         (5)  REQUIREMENTS FOR ADVERTISEMENTS.--Advertising in

16  which items are offered as free with conditions or obligations

17  necessary to acceptance shall include a clear and conspicuous

18  statement of any such conditions or obligations and

19  advertising in compliance herewith shall not be considered

20  deceptive. Any charges related to the shipping or handling of

21  free merchandise shall be the actual cost or a reasonable

22  approximation of the actual shipping and handling charges.

23         Section 2.  This act shall take effect July 1, 2003.
