6 certain medical professionals; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 110.1085, Florida Statutes, is
12 created to read:
13 110.1085 Legislative approval of certain
14 compensation.--
15 (1) A state employee may not be approved for a total
16 annual salary in excess of $200,000 without approval of the
17 Legislature. As used in this section, the term "salary"
18 includes all wages and non-health care benefits, including,
19 but not limited to, housing allowances, personal vehicle
20 allowances, and spouse travel allowances. An agency head must
21 petition the President of the Senate and Speaker of the House
22 of Representatives, providing copies to the minority leaders
23 of both houses, requesting legislative action on the salary
24 request. The petition must include documentation demonstrating
25 the reasons for the salary, including market factors,
26 employment history, and previous salaries of the employee. The
27 Legislature may approve the salary by concurrent resolution.
28 (2) When the Legislature is not within 30 days of
29 entering a regular session, the President of the Senate and
30 Speaker of the House of Representatives may request action by
31 the Joint Legislative Budget Commission. Approval from the

1 commission applies only for the current fiscal year. If the
2 term of employment extends beyond the current fiscal year, the
3 salary must be approved by the Legislature at the next regular
4 or special session.
5 (3) This chapter does not require legislative approval
6 for the salaries of medical professionals teaching at state
7 universities.
8 Section 2. This act shall take effect July 1, 2003.
