1 A bill to be entitled
2 An act relating to the Legislative Historic
3 Preservation Commission; creating s. 11.801,
4 F.S.; creating the Legislative Historic
5 Preservation Commission within the legislative
6 branch of government; providing for membership
7 of the commission and terms of office;
8 providing powers and duties of the commission;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 11.801, Florida Statutes, is
14 created to read:
15 11.801 Legislative Historic Preservation Commission
16 created; powers and duties.--
17 (1) There is created the Legislative Historic
18 Preservation Commission within the legislative branch of
19 government.
20 (2)(a) The commission shall consist of not more than
21 25 members, including:
22 1. Eight persons who are former members of the House
23 of Representatives, to be appointed by the Speaker of the
24 House of Representatives.
25 2. Eight persons who are former members of the Senate,
26 to be appointed by the President of the Senate.
27 3. The Clerk of the House of Representatives, the
28 Secretary of the Senate, and the Sergeant at Arms of each
29 house.
30 4. The director of the commission.

1 5. Up to four other persons selected by the
2 commission.
3 (b) The persons appointed under subparagraphs (a)1.
4 and 2. shall be appointed to serve staggered terms of 4 years.
5 Of the initial appointees, two persons appointed by the
6 Speaker of the House of Representatives and two persons
7 appointed by the President of the Senate shall be appointed to
8 serve terms of 4 years, two persons appointed by the Speaker
9 and two persons appointed by the President shall be appointed
10 to serve terms of 3 years, two persons appointed by the
11 Speaker and two persons appointed by the President shall be
12 appointed to serve terms of 2 years, and the remaining
13 appointees shall be appointed to serve terms of 1 year, as
14 determined by the appointing presiding officer. In making the
15 initial appointments, each presiding officer must reappoint
16 any current or former member of the house over which the
17 presiding officer presides; however, if more than six such
18 persons are presently serving on the commission, the presiding
19 officer need reappoint only six of such persons. The terms of
20 the initial appointees shall begin July 1, 2003.
21 (3) The commission shall elect from among its members
22 a chair and vice chair and such other officers as it desires.
23 The commission shall adopt its own rules of procedure, except
24 that with respect to the provisions of s. 24, Art. I of the
25 State Constitution, the commission shall abide by the rules of
26 both houses regarding the enforcement of the section. The
27 rules of procedure must provide that the meetings of the
28 commission will be open and that the public will be given
29 notice of the meetings.
30 (4) The commission shall employ a director who must be
31 appointed by the commission with the advice and consent of the

1 President of the Senate and the Speaker of the House of
2 Representatives and shall serve at the pleasure of those
3 legislative officers.
4 (5) Members of the commission shall receive no
5 compensation for their service on the commission but may be
6 reimbursed for per diem and travel expenses pursuant to s.
7 112.061.
8 (6) The commission shall meet at the call of the chair
9 at least twice annually.
10 (7) The duties of the commission shall include:
11 (a) Serving the Legislature with respect to the
12 collection and preservation of the historic records of both
13 houses of the Legislature. The commission shall provide a plan
14 for the collection of historical information that is written,
15 oral, anecdotal, or in the nature of artifacts.
16 (b) Providing for the availability of the historical
17 information identified by the commission by the most
18 appropriate means available, including by electronic
19 transmission. The commission may also use any means available
20 to entities created under chapters 257 and 267.
21 (c) Assisting in the development and provision of
22 educational opportunities that illustrate the historical
23 aspects of the legislative process, using the physical
24 facilities of the Legislature, the Historic Capitol, the R. A.
25 Gray Building, and any other appropriate properties.
26 (d) Overseeing and maintaining the operation of the
27 Legislative Research Center and Museum located on the campus
28 of Tallahassee Community College in Tallahassee.
29 (e) Overseeing, collecting, and expending funds
30 allocated by the Legislature and any other funds received from
31 other sources.

1 (f) Performing such other duties as the commission
2 considers necessary to the historic preservation of the
3 records of the Legislature.
4 (8) In addition to other powers granted under this
5 section, the commission may:
6 (a) Make and enter into such contracts and agreements
7 as it determines are necessary, expedient, or incidental to
8 the performance of its duties.
9 (b) Accept gifts, grants, bequests, loans, and
10 endowments for purposes not inconsistent with its
11 responsibilities under this section.
12 Section 2. This act shall take effect July 1, 2003.
