1 A bill to be entitled
2 An act relating to public school assessment and
3 accountability; amending s. 1008.34, F.S.;
4 revising provisions relating to student
5 assessment data used in determining school
6 performance grade category designations;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (b) of subsection (3) of section
12 1008.34, Florida Statutes, is amended to read:
13 1008.34 School grading system; district performance
14 grade.--
15 (3) DESIGNATION OF SCHOOL PERFORMANCE GRADE
16 CATEGORIES.--School performance grade category designations
17 itemized in subsection (2) shall be based on the following:
18 (b) Student assessment data.--Student assessment data
19 used in determining school performance grade categories shall
20 include:
21 1. The aggregate scores of all eligible students
22 enrolled in the school who have been assessed on the FCAT. A
23 student in grade 11 or grade 12 who receives passing scores on
24 the grade 10 FCAT, including a student who did not earn
25 passing scores on initial testing in grade 10, shall be given
26 the same weight as a student in grade 10 who receives passing
27 scores on the grade 10 FCAT for the purpose of determining a
28 school's performance grade category designation.
29 2. The aggregate scores of all eligible students
30 enrolled in the school who have been assessed on the FCAT,
31 including Florida Writes, and who have scored at or in the

1 lowest 25th percentile of students in the school in reading,
2 math, or writing, unless these students are performing above
3 satisfactory performance.

5 The Department of Education shall study the effects of
6 mobility on the performance of highly mobile students and
7 recommend programs to improve the performance of such
8 students. The State Board of Education shall adopt appropriate
9 criteria for each school performance grade category. The
10 criteria must also give added weight to student achievement in
11 reading. Schools designated as performance grade category "C,"
12 making satisfactory progress, shall be required to demonstrate
13 that adequate progress has been made by students in the school
14 who are in the lowest 25th percentile in reading, math, or
15 writing on the FCAT, including Florida Writes, unless these
16 students are performing above satisfactory performance.
17 Section 2. This act shall take effect July 1, 2003.
