  1                      A bill to be entitled

  2         An act relating to regulation of professions

  3         and occupations; repealing ss. 468.401,

  4         468.402, 468.403, 468.404, 468.405, 468.406,

  5         468.407, 468.408, 468.409, 468.410, 468.411,

  6         468.412, 468.413, 468.414, 468.415, F.S.,

  7         relating to the regulation of talent agencies;

  8         repealing ss. 468.431, 468.4315, 468.432,

  9         468.433, 468.4336, 468.4337, 468.4338, 468.435,

10         468.436, 468.4365, 468.437, 468.438, F.S.,

11         relating to the regulation of community

12         association managers; repealing requirements

13         that the respective occupations be licensed by

14         the Department of Business and Professional

15         Regulation; abolishing the Regulatory Council

16         of Community Association Managers; providing

17         for the use and transfer of funds; providing

18         for the department to continue outstanding

19         legal proceedings; providing an effective date.

21  Be It Enacted by the Legislature of the State of Florida:

22  

23         Section 1.  Sections 468.401, 468.402, 468.403,

24  468.404, 468.405, 468.406, 468.407, 468.408, 468.409, 468.410,

25  468.411, 468.412, 468.413, 468.414, and 468.415, Florida

26  Statutes, are repealed.

27         Section 2.  The regulation of talent agencies is

28  abolished. Any funds and balances associated with the

29  regulation of talent agencies remaining in the Professional

30  Regulation Trust Fund after the effective date of this act

31  shall be used to pay any remaining expenses associated with

 1  this regulation. Any funds or balances remaining in the trust

 2  fund after January 1, 2004, shall be transferred to the

 3  General Revenue Fund.

 4         Section 3.  The Department of Business and Professional

 5  Regulation may continue to prosecute any legal proceedings and

 6  related administrative cases that are in existence on the

 7  effective date of this act.

 8         Section 4.  Sections 468.431, 468.4315, 468.432,

 9  468.433, 468.4336, 468.4337, 468.4338, 468.435, 468.436,

10  468.4365, 468.437, and 468.438, Florida Statutes, are

11  repealed.

12         Section 5.  The Regulatory Council of Community

13  Association Managers is abolished. Any funds and balances

14  associated with the regulation of community association

15  managers remaining in the Professional Regulation Trust Fund

16  after the effective date of this act shall be used to pay any

17  remaining expenses associated with this regulation. Any funds

18  or balances remaining in the trust fund after January 1, 2004,

19  shall be transferred to the General Revenue Fund.

20         Section 6.  The Department of Business and Professional

21  Regulation may continue to prosecute any legal proceedings and

22  related administrative cases that are in existence on the

23  effective date of this act.

24         Section 7.  This act shall take effect upon becoming a

25  law.

 2                          SENATE SUMMARY

 3    Deregulates the occupations of talent agency and
      community association manager. Provides for the eventual
 4    transfer of moneys in the Professional Regulation Trust
      Fund to the General Revenue Fund. Allows the Department
 5    of Business and Professional Regulation to continue legal
      and administrative proceedings that are underway on the
 6    effective date of the act.
