  1                      A bill to be entitled

  2         An act relating to public funds; amending s.

  3         215.85, F.S.; authorizing local governments to

  4         pay certain expenses by means of electronic

  5         funds transfer; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Subsection (5) of section 215.85, Florida

10  Statutes, is amended to read:

11         215.85  Direct deposit of public funds.--

12         (5)  PROCEDURES FOR WIRE TRANSFER OF

13  FUNDS.--Notwithstanding any other provision of law, the

14  governing board or officer of any local government who has the

15  authority to deposit or withdraw funds is authorized to

16  transfer funds from one depository to another or within a

17  depository or to another institution, and may transfer funds

18  wherein the transfer does not represent an expenditure,

19  advance, or reduction of cash assets, except that a local

20  government may electronically transfer funds to pay expenses

21  evidenced by a valid invoice.  Such transfer may be made by

22  electronic, telephonic, or other medium; and each transfer

23  shall be confirmed in writing and signed by the designee of

24  the governing board or officer of the local government.

25         Section 2.  This act shall take effect July 1, 2003.
