  1                      A bill to be entitled

  2         An act relating to the interception of wire,

  3         oral, or electronic communications; amending s.

  4         934.03, F.S.; limiting provisions that allow

  5         certain officers to intercept such

  6         communications; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (c) of subsection (2) of section

11  934.03, Florida Statutes, is amended to read:

12         934.03  Interception and disclosure of wire, oral, or

13  electronic communications prohibited.--

14         (2)

15         (c)  It is lawful under ss. 934.03-934.09 for an

16  investigative or law enforcement officer or a person acting

17  under the direction of an investigative or law enforcement

18  officer to intercept a wire, oral, or electronic communication

19  when such person is a party to the communication or one of the

20  parties to the communication has given prior consent to such

21  interception and the purpose of such interception is to obtain

22  evidence of a criminal act related to the investigation of a

23  felony, misdemeanor, or noncriminal violation that the officer

24  is authorized to enforce.

25         Section 2.  This act shall take effect July 1, 2003.
