1 A bill to be entitled
2 An act relating to the Board of Dentistry;
3 amending s. 466.004, F.S.; revising membership
4 of the Council on Dental Hygiene; revising
5 provisions relating to meetings; requiring the
6 board to adopt rules and policies developed by
7 the council, except as specified; providing for
8 the Department of Health to resolve
9 disagreements concerning recommendations by the
10 council; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Paragraph (a) of subsection (2) and
15 subsection (4) of section 466.004, Florida Statutes, are
16 amended to read:
17 466.004 Board of Dentistry.--
18 (2) To advise the board, it is the intent of the
19 Legislature that councils be appointed as specified in
20 paragraphs (a), (b), and (c). The department shall provide
21 administrative support to the councils and shall provide
22 public notice of meetings and agenda of the councils. Councils
23 shall include at least one board member who shall chair the
24 council and shall include nonboard members. All council
25 members shall be appointed by the board chair. Council members
26 shall be appointed for 4-year terms, and all members shall be
27 eligible for reimbursement of expenses in the manner of board
28 members.
29 (a) A Council on Dental Hygiene shall be appointed as
30 follows: the two dental hygienist members by the board chair
31 and shall include one dental hygienist member of the board, a

1 dentist who shall chair the council, one dental member of the
2 board appointed by the board, and two three dental hygienists
3 who are actively engaged in the practice of dental hygiene in
4 this state and who shall be appointed by the Governor. The
5 Dental Hygiene Council is a body administratively attached to
6 and supported by the board through which the board regulates
7 dental hygienists and the practice of dental hygiene. The
8 council shall meet at least twice in each calendar year at the
9 request of the board chair, a majority of the members of the
10 board, or the council chair. Additional meetings may be called
11 at the request of a majority of the members of the council or
12 the council chair. The council is charged with the
13 responsibility of and shall meet for the purpose of developing
14 all rules and policies for recommendation to the board, which
15 the board shall consider, on matters pertaining to that part
16 of dentistry consisting of educational, preventive, or
17 therapeutic dental hygiene services; dental hygiene licensure,
18 discipline, or regulation; and dental hygiene education, which
19 the council shall submit to the board as recommendations. The
20 board must ratify the recommendations of the council and adopt
21 the recommendations as rules of the board unless the board
22 makes a specific finding that a recommendation is beyond the
23 jurisdiction of the council, has an undue financial effect on
24 the board, or is not supported by the record. If the council
25 disagrees with such a finding of the board, the department
26 shall decide whether the board must ratify the recommendation.
27 (4) The board is authorized to adopt rules pursuant to
28 ss. 120.536(1) and 120.54 to implement the provisions of this
29 chapter and chapter 456, including the establishment of a fee
30 to defray the cost of duplicating any license certification or
31 permit, not to exceed $10 per duplication; however, any rule

1 concerning dental hygiene services, licensure discipline,
2 regulation, or education must be made on the recommendation of
3 the dental hygiene council pursuant to paragraph (2)(a).
4 Section 2. This act shall take effect July 1, 2003.
