SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 (5) The institutes are: 2 (a) Florida-Brazil Institute (University of Florida 3 and Miami-Dade Community College). 4 (g) Florida-France Institute (New College of the 5 University of South Florida, Miami-Dade Community College, and 6 Florida State University). 7 Section 3. Paragraph (a) of subsection (2) of section 8 1002.35, Florida Statutes, is amended to read: 9 1002.35 New World School of the Arts.-- 10 (2)(a) For purposes of governance, the New World 11 School of the Arts is assigned to Miami-Dade Community 12 College, the Dade County School District, and one or more 13 universities designated by the State Board of Education. The 14 State Board of Education shall assign to the New World School 15 of the Arts a university partner or partners. In this 16 selection, the State Board of Education shall consider the 17 accreditation status of the core programs. Florida 18 International University, in its capacity as the provider of 19 university services to Dade County, shall be a partner to 20 serve the New World School of the Arts, upon meeting the 21 accreditation criteria. The respective boards shall appoint 22 members to an executive board for administration of the 23 school. The executive board may include community members and 24 shall reflect proportionately the participating institutions. 25 Miami-Dade Community College shall serve as fiscal agent for 26 the school. 27 Section 4. SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 create an innovative means to increase access to baccalaureate 2 degree level education in populous counties that are 3 underserved by public baccalaureate degree granting 4 institutions. This education is intended to address the 5 state's workforce needs, especially the need for teachers, 6 nurses, and business managers in agencies and firms that 7 require expertise in technology. 8 (2) ST. PETERSBURG COLLEGE; MIAMI-DADE COLLEGE; 9 CHIPOLA COLLEGE; MISSION; POLICIES.--St. Petersburg College, 10 Miami-Dade College, and Chipola College shall immediately seek 11 accreditation from the Southern Association of Colleges and 12 Schools as a baccalaureate degree granting college. 13 (a) The primary mission of St. Petersburg College, 14 Miami-Dade College, and Chipola College is to provide 15 high-quality undergraduate education at an affordable price 16 for students and the state. The purpose is to promote economic 17 development by preparing people for occupations that require a 18 bachelor's degree and are in demand by existing or emerging 19 public and private employers in this state. 20 (b) St. Petersburg College, Miami-Dade College, and 21 Chipola College shall maintain the mission and policies of a 22 Florida community college, including the open-door admissions 23 policy and the authority to offer all programs consistent with 24 a community college's authority. 25 (c) St. Petersburg College shall maintain the 26 distinction between the college and its university center. St. 27 Petersburg College is limited to community college programs 28 and to selected baccalaureate degree level programs that meet 29 community needs and are authorized as provided by this 30 section. SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 participating college or university and are not to be 2 classified or funded as programs of St. Petersburg College. 3 (d) The academic policies of the upper-division 4 programs program at St. Petersburg College, Miami-Dade 5 College, and Chipola College must be in accordance with 6 policies of the State Board of Education. 7 (e) Sections 1013.39 and 1013.82 apply to St. 8 Petersburg College, Miami-Dade College, and Chipola College. 9 (3) STUDENTS; FEES.-- 10 (a) St. Petersburg College, Miami-Dade College, and 11 Chipola College shall maintain separate records for students 12 who are enrolled in courses classified in the upper division 13 and lower division of a baccalaureate program, according to 14 the statewide course numbering system. A student shall be 15 reported as a community college student for enrollment in a 16 lower-division course and as a baccalaureate degree program 17 student for enrollment in an upper-division course. 18 (b) The Board of Trustees of St. Petersburg College 19 the Board of Trustees of Miami-Dade College, and the Board of 20 Trustees of Chipola College shall establish the level of 21 tuition and other authorized student fees consistent with law 22 and proviso in the General Appropriations Act. 23 1. For each credit hour of enrollment in a certificate 24 level course or lower-division level college credit course, 25 tuition and fees must be within the range authorized in law 26 and rule for a community college student at that level. 27 2. For each credit hour of enrollment in an 28 upper-division level course, matriculation and tuition fees 29 must be in an amount established by the Board of Trustees of 30 St. Petersburg College, the Board of Trustees of Miami-Dade 31 College, and the Board of Trustees of Chipola College. 4 6:35 PM 04/09/03 s2626.ed.01
SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 However, fees for upper-division students must reflect the 2 fact that the college does not incur the costs of major 3 research programs. Therefore, the board of trustees shall 4 establish fees for upper-division students within a range that 5 is lower than the fees established for students at a state 6 university but higher than the fees for community college 7 students. 8 3. Other mandatory fees and local fees must be at the 9 same level for all lower-division students. For upper-division 10 students, other mandatory fees and local fees must be at a 11 level less than fees established for university of South 12 Florida students, regardless of program enrollment or level. 13 However, students in workforce development education courses 14 maintain the authorized fee exemptions described in s. 1009.25 15 and may be exempt from local fees imposed by the board of 16 trustees, at the board's discretion. 17 (4) DEGREES.-- 18 (a) In addition to the certificates, diplomas, and 19 degrees authorized in s. 1004.65, St. Petersburg College may 20 offer selected baccalaureate degrees. Initially, the college 21 may offer programs that lead to a baccalaureate degree in the 22 following fields: 23 1. Bachelor of Science in Nursing. This program must 24 be designed to articulate with the associate in science degree 25 in nursing. St. Petersburg College shall continue to offer the 26 associate in science degree in nursing. 27 2. Bachelor of Arts and Bachelor of Science in 28 Elementary Education. 29 3. Bachelor of Arts and Bachelor of Science in Special 30 Education. 31 4. SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 Secondary Education. 2 5. Bachelor of Applied Science in fields selected by 3 the Board of Trustees of St. Petersburg College. The board of 4 trustees shall base the selection on an analysis of workforce 5 needs and opportunities in the following counties: Pinellas, 6 Pasco, Hernando, and other counties approved by the Department 7 of Education. For each program selected, St. Petersburg 8 College must offer a related associate in science or associate 9 in applied science degree program, and the baccalaureate 10 degree level program must be designed to articulate fully with 11 at least one associate in science degree program. The college 12 is encouraged to develop articulation agreements for 13 enrollment of graduates of related associate in applied 14 science degree programs. 15 (b) Miami-Dade College obtained approval by the State 16 Board of Education to grant baccalaureate degrees in education 17 in the areas of exceptional student education and secondary 18 education in science and mathematics pursuant to s. 19 1007.33(3)(b). In addition to the certificates, diplomas, and 20 degrees authorized in s. 1004.65, Miami-Dade College may offer 21 selected baccalaureate degrees. Initially, the college may 22 offer programs that lead to a baccalaureate degree in the 23 following fields: 24 1. Bachelor of Arts and Bachelor of Science in 25 Exceptional Student Education. 26 2. Bachelor of Arts and Bachelor of Science in 27 Secondary Education. 28 29 Miami-Dade College may offer additional baccalaureate degrees 30 as approved by the State Board of Education. 31 (c) Chipola College obtained approval by the State 6 6:35 PM 04/09/03 s2626.ed.01
SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 Board of Education to grant baccalaureate degrees in education 2 in the area of secondary education pursuant to s. 3 1007.33(3)(b). In addition to the certificates, diplomas, and 4 degrees authorized in s. 1004.65, Chipola College may offer 5 selected baccalaureate degrees. Initially, the college may 6 offer programs that lead to a Bachelor of Arts in Secondary 7 Education. 8 (d)(b) St. Petersburg College, Miami-Dade College, and 9 Chipola College may offer courses that enable teachers to 10 qualify for certification and recertification as required by 11 law or rule. 12 (e)(c) St. Petersburg College, Miami-Dade College, and 13 Chipola College may offer programs to provide opportunities 14 for a person who holds a baccalaureate degree, but is not 15 certified to teach, to obtain any additional courses required 16 for teacher certification. 17 (f)(d) Master's degree level programs and doctoral 18 programs may be provided by agreement with a college or 19 university participating in the University Center of St. 20 Petersburg College. 21 (g)(e) For those students living outside Pinellas 22 County, St. Petersburg College shall recruit for the upper 23 division only those students who have earned an associate 24 degree. In recruiting upper-division students in Pasco and 25 Hernando Counties, St. Petersburg College shall work 26 cooperatively with Pasco-Hernando Community College and shall 27 seek to offer courses and programs at Pasco-Hernando Community 28 College when feasible. The nursing programs, in particular, 29 must be conducted cooperatively, and programs at St. 30 Petersburg College shall not conflict with Pasco-Hernando 31 Community College's and the University of South Florida's 7 6:35 PM 04/09/03 s2626.ed.01
SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 cooperative nursing program. 2 (5) BOARDS.-- 3 (a) The Board of Trustees of St. Petersburg College, 4 the Board of Trustees of Miami-Dade College, and the Board of 5 Trustees of Chipola College serves as the college's governing 6 Boards of the colleges board. The Governor shall appoint 7 members as provided in s. 1001.61, and the boards shall have 8 board has the duties and authorities granted in ss. 1001.63 9 and 1001.64 and by rules of the State Board of Education. 10 (b) The Board of Trustees of St. Petersburg College, 11 the Board of Trustees of Miami-Dade College, and the Board of 12 Trustees of Chipola College may authorize direct-support 13 organizations as authorized in ss. 1004.28 and 1004.70. 14 (c) The Board of Trustees of St. Petersburg College 15 may continue to award degrees, diplomas, and certificates as 16 authorized for St. Petersburg Junior College, and in the name 17 of St. Petersburg Junior College, until St. Petersburg College 18 receives its accreditation. 19 (d) The Board of Trustees of Miami-Dade College may 20 continue to award degrees, diplomas, and certificates as 21 authorized for Miami-Dade Community College, and in the name 22 of Miami-Dade Community College, until Miami-Dade College 23 receives its accreditation. 24 (e) The Board of Trustees of Chipola College may 25 continue to award degrees, diplomas, and certificates as 26 authorized for Chipola Junior College, and in the name of 27 Chipola Junior College, until Chipola College receives its 28 accreditation. 29 (f)(d) A coordinating board shall assist the Board of 30 Trustees in its deliberations concerning issues that affect 31 the upper division of St. Petersburg College. SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 board consists of the President of the University of South 2 Florida, the President of St. Petersburg College, the 3 President of Pasco-Hernando Community College, and the chairs 4 of the boards of trustees of those institutions. 5 1.(e) Beginning 4 years after the college receives 6 accreditation to offer baccalaureate degrees, the Board of 7 Trustees of St. Petersburg College may determine additional 8 programs to be offered, with the approval of the coordinating 9 board. The determination must consider community needs and 10 economic opportunities. 11 2.(f) The coordinating board shall meet at the request 12 of the President of the University of South Florida or the 13 President of St. Petersburg College. 14 3.(g) If the coordinating board cannot decide an issue 15 of importance to the programs designed for upper-division 16 students, the State Board of Education shall resolve the 17 issue. 18 (6) EMPLOYEES.-- 19 (a) Employment at St. Petersburg College, Miami-Dade 20 College, and Chipola College is governed by the same laws that 21 govern community colleges, except that upper-division faculty 22 At St. Petersburg College are eligible for continuing 23 contracts upon the completion of the fifth year of teaching. 24 (b) Employee records for all personnel shall be 25 maintained as required by s. 1012.81. 26 (7) FACILITIES.-- 27 (a) St. Petersburg College may request funding from 28 the Public Education Capital Outlay and Debt Service Trust 29 Fund as a community college and as a university. The Board of County 6 Commissioners of Pinellas County and all municipalities in 7 Pinellas County may exercise the power of eminent domain to 8 acquire lands, buildings, and equipment for the use of St. 9 Petersburg College, regardless of whether such lands, 10 buildings, and equipment are located in a community 11 redevelopment area. 12 (b) Miami-Dade College may request funding from the 13 Public Education Capital Outlay and Debt Service Trust Fund as 14 a community college and as a university. The municipalities in 15 Miami-Dade County, The Board of County Commissioners of 16 Miami-Dade County, and all other governmental entities are 17 authorized to cooperate with the Board of Trustees of 18 Miami-Dade College in establishing this institution. The Boards of County Commissioners of 7 Jackson, Liberty, Holmes, Calhoun, and Washington Counties and 8 all municipalities in those counties may exercise the power of 9 eminent domain to acquire lands, buildings, and equipment for 10 the use of Chipola College, regardless of whether such lands, 11 buildings, and equipment are located in a community 12 redevelopment area. 13 (8) STATE FUNDING.-- 14 (a) The Legislature intends to fund St. Petersburg 15 College, Miami-Dade College, and Chipola College as a 16 community colleges college for their its workforce development 17 education programs and for their its lower-division level 18 college credit courses and programs. 19 (b) The Legislature intends to fund St. Petersburg 20 College, Miami-Dade College, and Chipola College as a 21 baccalaureate degree level institutions institution for their 22 its upper-division level courses and programs. 23 Section 5. Subsection (2) of section 1004.76, Florida 24 Statutes, is amended to read: 25 1004.76 Florida Martin Luther King, Jr., Institute for 26 Nonviolence.-- 27 (2) There is hereby created the Florida Martin Luther 28 King, Jr., Institute for Nonviolence to be established at 29 Miami-Dade Community College. SENATE AMENDMENT Bill No. SB 2626 Amendment No. 1 Barcode 852630 1 members to be appointed by the Governor, such members to 2 represent the population of the state based on its ethnic, 3 gender, and socioeconomic diversity. Of the members appointed 4 by the Governor, one shall be a member of the Senate appointed 5 by the Governor on the recommendation of the President of the 6 Senate; one shall be a member of the Senate appointed by the 7 Governor on the recommendation of the minority leader; one 8 shall be a member of the House of Representatives appointed by 9 the Governor on the recommendation of the Speaker of the House 10 of Representatives; one shall be a member of the House of 11 Representatives appointed by the Governor on the 12 recommendation of the minority leader; and seven shall be 13 members appointed by the Governor, no more than three of whom 14 shall be members of the same political party. The following 15 groups shall be represented by the seven members: the Florida 16 Sheriffs Association; the Florida Association of Counties; the 17 Florida League of Cities; state universities human services 18 agencies; community relations or human relations councils; and 19 youth. A chairperson shall be elected by the members and 20 shall serve for a term of 3 years. Members of the board shall 21 serve the following terms of office which shall be staggered: 22 (a) A member of the Legislature appointed to the board 23 shall serve for a single term not to exceed 5 years and shall 24 serve as a member only while he or she is a member of the 25 Legislature. 26 (b) Of the seven members who are not members of the 27 Legislature, three shall serve for terms of 4 years, two shall 28 serve for terms of 3 years, and one shall serve for a term of 29 1 year. Thereafter, each member, except for a member 30 appointed to fill an unexpired term, shall serve for a 5-year 31 term.
