3 amending s. 320.089, F.S.; creating the
4 Professional Firefighters license plate;
5 providing for the distribution of annual use
6 fees received from the sale of such plates;
7 amending ss. 320.08056 and 320.08058, F.S.;
8 creating the Family First license plate;
9 providing for the distribution of annual use
10 fees received from the sale of such plates;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 320.089, Florida Statutes, is
16 amended to read:
17 320.089 Limited-issue specialty Members of National
18 Guard and active United States Armed Forces reservists; former
19 prisoners of war; survivors of Pearl Harbor; Purple Heart
20 medal recipients; special license plates; fee.--
21 (1) MEMBERS OF NATIONAL GUARD AND ACTIVE UNITED STATES
22 ARMED FORCES RESERVISTS; SURVIVORS OF PEARL HARBOR; PURPLE
23 HEART MEDAL RECIPIENTS.--
24 (a) Each owner or lessee of an automobile or truck for
25 private use or recreational vehicle as specified in s.
26 320.08(9)(c) or (d), which is not used for hire or commercial
27 use, who is a resident of the state and an active or retired
28 member of the Florida National Guard, a survivor of the attack
29 on Pearl Harbor, a recipient of the Purple Heart medal, or an
30 active member of any branch of the United States Armed Forces
31 Reserve shall, upon application to the department, accompanied

1 by proof of active membership or retired status in the Florida
2 National Guard, proof of membership in the Pearl Harbor
3 Survivors Association or proof of active military duty in
4 Pearl Harbor on December 7, 1941, proof of being a Purple
5 Heart medal recipient, or proof of active membership in any
6 branch of the Armed Forces Reserve, and upon payment of the
7 license tax for the vehicle as provided in s. 320.08, be
8 issued a license plate as provided by s. 320.06, upon which,
9 in lieu of the serial numbers prescribed by s. 320.06, shall
10 be stamped the words "National Guard," "Pearl Harbor
11 Survivor," "Combat-wounded veteran," or "U.S. Reserve," as
12 appropriate, followed by the serial number of the license
13 plate. Additionally, the Purple Heart plate may have the words
14 "Purple Heart" stamped on the plate and the likeness of the
15 Purple Heart medal appearing on the plate.
16 (b) Notwithstanding any other provision of law to the
17 contrary, beginning with fiscal year 2002-2003 and annually
18 thereafter, the first $100,000 in general revenue generated
19 from the sale of license plates issued under this section
20 which are stamped with the words "National Guard," "Pearl
21 Harbor Survivor," "Combat-wounded veteran," or "U.S. Reserve"
22 shall be deposited into the Grants and Donations Trust Fund,
23 as described in s. 296.38(2), to be used for the purposes
24 established by law for that trust fund.
25 (c) Notwithstanding any provisions of law to the
26 contrary, an applicant for a Pearl Harbor Survivor license
27 plate or a Purple Heart license plate who also qualifies for a
28 disabled veteran's license plate under s. 320.084 shall be
29 issued the appropriate special license plate without payment
30 of the license tax imposed by s. 320.08.

1 (2) FORMER PRISONERS OF WAR.--Each owner or lessee of
2 an automobile or truck for private use, truck weighing not
3 more than 7,999 pounds, or recreational vehicle as specified
4 in s. 320.08(9)(c) or (d), which is not used for hire or
5 commercial use, who is a resident of the state and who is a
6 former prisoner of war, or their unremarried surviving spouse,
7 shall, upon application therefor to the department, be issued
8 a license plate as provided in s. 320.06, on which license
9 plate are stamped the words "Ex-POW" followed by the serial
10 number. Each application shall be accompanied by proof that
11 the applicant meets the qualifications specified in paragraph
12 (a) or paragraph (b).
13 (a) A citizen of the United States who served as a
14 member of the Armed Forces of the United States or the armed
15 forces of a nation allied with the United States who was held
16 as a prisoner of war at such time as the Armed Forces of the
17 United States were engaged in combat, or their unremarried
18 surviving spouse, may be issued the special license plate
19 provided for in this subsection without payment of the license
20 tax imposed by s. 320.08.
21 (b) A person who was serving as a civilian with the
22 consent of the United States Government, or a person who was a
23 member of the Armed Forces of the United States who was not a
24 United States citizen and was held as a prisoner of war when
25 the Armed Forces of the United States were engaged in combat,
26 or their unremarried surviving spouse, may be issued the
27 special license plate provided for in this subsection upon
28 payment of the license tax imposed by s. 320.08.
29 (3) PURPLE HEART MEDAL RECIPIENTS SURVIVING
30 SPOUSES.--Each owner or lessee of an automobile or truck for
31 private use, truck weighing not more than 7,999 pounds, or

1 recreational vehicle as specified in s. 320.08(9)(c) or (d),
2 which is not used for hire or commercial use, who is a
3 resident of this state and who is the unremarried surviving
4 spouse of a recipient of the Purple Heart medal shall, upon
5 application therefor to the department, with the payment of
6 the required fees, be issued a license plate as provided in s.
7 320.06, on which license plate are stamped the words "Purple
8 Heart" and the likeness of the Purple Heart medal followed by
9 the serial number. Each application shall be accompanied by
10 proof that the applicant is the unremarried surviving spouse
11 of a recipient of the Purple Heart medal.
12 (4) PROFESSIONAL FIREFIGHTERS.--Each owner or lessee
13 of an automobile or truck for private use or recreational
14 vehicle as specified in s. 320.08(9)(c) or (d), which is not
15 used for hire or commercial use, who is a resident of the
16 state and an active or retired professional firefighter, the
17 spouse of such professional firefighter, or the unremarried
18 surviving spouse of a professional firefighter shall, upon
19 application to the department and upon payment of the
20 applicable license taxes and a $25 use fee, be issued a
21 license plate as provided by s. 320.06. Each application shall
22 be accompanied by proof that the applicant is an active or
23 retired professional firefighter, the spouse of such
24 professional firefighter, or the unremarried surviving spouse
25 of a professional firefighter, including, but not limited to,
26 a current identification and badge or a letter from the
27 professional firefighters' association of which the
28 professional firefighter is or was a member.
29 (a) Notwithstanding any other provision of law, the
30 department shall develop a Professional Firefighter license
31 plate as provided in this subsection. Professional Firefighter

1 license plates must bear the colors and design approved by the
2 department. The word "Florida" must appear at the top of the
3 plate and the word "Firefighter" must appear at the bottom of
4 the plate.
5 (b) The proceeds of the annual use fee shall be
6 distributed equally to Shands Burn Center at the University of
7 Florida in Alachua County, Orlando Regional Medical Center
8 Burn Unit in Orange County, University of Miami-Jackson
9 Memorial Burn Center in Miami-Dade County, and Tampa General
10 Hospital Regional Burn Center in Hillsborough County. The
11 funds shall be used specifically for the burn center or unit
12 at each of those health care facilities.
13 Section 2. Paragraph (mm) is added to subsection (4)
14 of section 320.08056, Florida Statutes, to read:
15 320.08056 Specialty license plates.--
16 (4) The following license plate annual use fees shall
17 be collected for the appropriate specialty license plates:
18 (mm) Family First license plate, $25.
19 Section 3. Subsection (39) is added to section
20 320.08058, Florida Statutes, to read:
21 320.08058 Specialty license plates.--
22 (39) FAMILY FIRST LICENSE PLATES.--
23 (a) The department shall develop a Family First
24 license plate as provided in this section. The word "Florida"
25 must appear at the top of the plate, and the words "Family
26 First" must appear at the bottom of the plate.
27 (b) The annual use fees shall be distributed to Family
28 First to fund programs, projects, seminars, events, and family
29 resources that promote principles for building marriages,
30 guiding parents and single parents, and raising children.
31 Family First shall retain all revenues from the sale of the

1 plate until all startup costs for developing and establishing
2 the plate have been recovered. Up to 5 percent of the funds
3 received by Family First may be expended for administrative
4 costs directly associated with the operations of Family First.
5 Up to 20 percent of the funds received by Family First may be
6 expended for promotion and marketing of the license plate.
7 Family First may expend all remaining funds for programs.
8 Section 4. This act shall take effect July 1, 2003.

13 The CS removes an incorrect referenced section which provided
for the issuance of a Firefighter specialty license plate upon
14 payment of the appropriate license tax and an annual use fee
of $25.
15
The CS further clarifies DHSMV is directed to issue a
16 limited-issue Professional Firefighter's license plate for an
annual use fee of $25 in addition to applicable motor vehicle
17 registration taxes and fees. Only a resident of Florida who
is an active or retired professional firefighter, the spouse
18 of such a firefighter, or the un-remarried surviving spouse of
a professional firefighter is eligible to purchase the plate.
19 Each application for this plate must be accompanied by proof
of status, including, but not limited to, a current
20 identification and badge or a letter from the professional
firefighters' association of which the professional
21 firefighter is or was a member.
22 Also, the CS directs DHSMV to issue a Family First specialty
license plate. In addition to applicable motor vehicle
23 registration taxes and fees, a $25 annual use fee will be
charged for this new specialty license plate. The annual fees
24 will be distributed to Family First to fund programs,
projects, seminars, events, and family resources that promote
25 principles for building marriages, guiding parents and single
parents, and raising children.
