  1                      A bill to be entitled

  2         An act relating to health care practice

  3         parameters; repealing ss. 408.02, 440.13(15),

  4         F.S., relating to practice parameters; amending

  5         ss. 440.134, 627.6418, 627.6613, F.S., relating

  6         to worker's compensation managed care plans and

  7         health insurance policy coverage for

  8         mammograms; removing references and legislative

  9         intent, to conform; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Section 408.02, Florida Statutes, is

15  repealed.

16         Section 2.  Subsection (15) of section 440.13, Florida

17  Statutes, is repealed.

18         Section 3.  Subsection (11) of section 440.134, Florida

19  Statutes, is amended to read:

20         440.134  Workers' compensation managed care

21  arrangement.--

22         (11)  A description of the use of workers' compensation

23  practice parameters for health care services when adopted by

24  the agency.

25         Section 4.  Subsection (1) of section 627.6418, Florida

26  Statutes, is amended to read:

27         627.6418  Coverage for mammograms.--

28         (1)  An accident or health insurance policy issued,

29  amended, delivered, or renewed in this state must provide

30  coverage for at least the following:

 1         (a)  A baseline mammogram for any woman who is 35 years

 2  of age or older, but younger than 40 years of age.

 3         (b)  A mammogram every 2 years for any woman who is 40

 4  years of age or older, but younger than 50 years of age, or

 5  more frequently based on the patient's physician's

 6  recommendation.

 7         (c)  A mammogram every year for any woman who is 50

 8  years of age or older.

 9         (d)  One or more mammograms a year, based upon a

10  physician's recommendation, for any woman who is at risk for

11  breast cancer because of a personal or family history of

12  breast cancer, because of having a history of biopsy-proven

13  benign breast disease, because of having a mother, sister, or

14  daughter who has or has had breast cancer, or because a woman

15  has not given birth before the age of 30.

17  It is the intent of the Legislature that, when practice

18  parameters for the delivery of mammography services are

19  developed pursuant to s. 408.02(7), the Legislature review the

20  requirements of this section and conform to the practice

21  parameters.

22         Section 5.  Subsection (1) of section 627.6613, Florida

23  Statutes, is amended to read:

24         627.6613  Coverage for mammograms.--

25         (1)  A group, blanket, or franchise accident or health

26  insurance policy issued, amended, delivered, or renewed in

27  this state must provide coverage for at least the following:

28         (a)  A baseline mammogram for any woman who is 35 years

29  of age or older, but younger than 40 years of age.

30         (b)  A mammogram every 2 years for any woman who is 40

31  years of age or older, but younger than 50 years of age, or

 1  more frequently based on the patient's physician's

 2  recommendation.

18         Section 6.  This act shall take effect upon becoming a

19  law.
