1 A bill to be entitled
2 An act relating to limited-issue specialty
3 license plates; amending ss. 320.08056 and
4 320.089, F.S.; creating the Valor license
5 plate; providing for the distribution of annual
6 use fees received from the sale of such plates;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Paragraph (mm) is added to subsection (4)
12 of section 320.08056, Florida Statutes, to read:
13 320.08056 Specialty license plates.--
14 (4) The following license plate annual use fees shall
15 be collected for the appropriate specialty license plates:
16 (mm) Valor license plate, $25.
17 Section 2. Section 320.089, Florida Statutes, is
18 amended to read:
19 320.089 Limited-issue specialty Members of National
20 Guard and active United States Armed Forces reservists; former
21 prisoners of war; survivors of Pearl Harbor; Purple Heart
22 medal recipients; special license plates; fee.--
23 (1) MEMBERS OF NATIONAL GUARD AND ACTIVE UNITED STATES
24 ARMED FORCES RESERVISTS; SURVIVORS OF PEARL HARBOR; PURPLE
25 HEART MEDAL RECIPIENTS.--
26 (a) Each owner or lessee of an automobile or truck for
27 private use or recreational vehicle as specified in s.
28 320.08(9)(c) or (d), which is not used for hire or commercial
29 use, who is a resident of the state and an active or retired
30 member of the Florida National Guard, a survivor of the attack
31 on Pearl Harbor, a recipient of the Purple Heart medal, or an

1 active member of any branch of the United States Armed Forces
2 Reserve shall, upon application to the department, accompanied
3 by proof of active membership or retired status in the Florida
4 National Guard, proof of membership in the Pearl Harbor
5 Survivors Association or proof of active military duty in
6 Pearl Harbor on December 7, 1941, proof of being a Purple
7 Heart medal recipient, or proof of active membership in any
8 branch of the Armed Forces Reserve, and upon payment of the
9 license tax for the vehicle as provided in s. 320.08, be
10 issued a license plate as provided by s. 320.06, upon which,
11 in lieu of the serial numbers prescribed by s. 320.06, shall
12 be stamped the words "National Guard," "Pearl Harbor
13 Survivor," "Combat-wounded veteran," or "U.S. Reserve," as
14 appropriate, followed by the serial number of the license
15 plate. Additionally, the Purple Heart plate may have the words
16 "Purple Heart" stamped on the plate and the likeness of the
17 Purple Heart medal appearing on the plate.
18 (b) Notwithstanding any other provision of law to the
19 contrary, beginning with fiscal year 2002-2003 and annually
20 thereafter, the first $100,000 in general revenue generated
21 from the sale of license plates issued under this section
22 which are stamped with the words "National Guard," "Pearl
23 Harbor Survivor," "Combat-wounded veteran," or "U.S. Reserve"
24 shall be deposited into the Grants and Donations Trust Fund,
25 as described in s. 296.38(2), to be used for the purposes
26 established by law for that trust fund.
27 (c) Notwithstanding any provisions of law to the
28 contrary, an applicant for a Pearl Harbor Survivor license
29 plate or a Purple Heart license plate who also qualifies for a
30 disabled veteran's license plate under s. 320.084 shall be

1 issued the appropriate special license plate without payment
2 of the license tax imposed by s. 320.08.
3 (2) FORMER PRISONERS OF WAR.--Each owner or lessee of
4 an automobile or truck for private use, truck weighing not
5 more than 7,999 pounds, or recreational vehicle as specified
6 in s. 320.08(9)(c) or (d), which is not used for hire or
7 commercial use, who is a resident of the state and who is a
8 former prisoner of war, or their unremarried surviving spouse,
9 shall, upon application therefor to the department, be issued
10 a license plate as provided in s. 320.06, on which license
11 plate are stamped the words "Ex-POW" followed by the serial
12 number. Each application shall be accompanied by proof that
13 the applicant meets the qualifications specified in paragraph
14 (a) or paragraph (b).
15 (a) A citizen of the United States who served as a
16 member of the Armed Forces of the United States or the armed
17 forces of a nation allied with the United States who was held
18 as a prisoner of war at such time as the Armed Forces of the
19 United States were engaged in combat, or their unremarried
20 surviving spouse, may be issued the special license plate
21 provided for in this subsection without payment of the license
22 tax imposed by s. 320.08.
23 (b) A person who was serving as a civilian with the
24 consent of the United States Government, or a person who was a
25 member of the Armed Forces of the United States who was not a
26 United States citizen and was held as a prisoner of war when
27 the Armed Forces of the United States were engaged in combat,
28 or their unremarried surviving spouse, may be issued the
29 special license plate provided for in this subsection upon
30 payment of the license tax imposed by s. 320.08.

1 (3) PURPLE HEART MEDAL RECIPIENTS SURVIVING
2 SPOUSES.--Each owner or lessee of an automobile or truck for
3 private use, truck weighing not more than 7,999 pounds, or
4 recreational vehicle as specified in s. 320.08(9)(c) or (d),
5 which is not used for hire or commercial use, who is a
6 resident of this state and who is the unremarried surviving
7 spouse of a recipient of the Purple Heart medal shall, upon
8 application therefor to the department, with the payment of
9 the required fees, be issued a license plate as provided in s.
10 320.06, on which license plate are stamped the words "Purple
11 Heart" and the likeness of the Purple Heart medal followed by
12 the serial number. Each application shall be accompanied by
13 proof that the applicant is the unremarried surviving spouse
14 of a recipient of the Purple Heart medal.
15 (4) VALOR DECORATION.--Each owner or lessee of an
16 automobile or truck for private use or recreational vehicle as
17 specified in s. 320.08(9)(c) or (d), which is not used for
18 hire or commercial use, who is a resident of the state and the
19 recipient of a military decoration for valor shall, upon
20 application to the department and upon payment of the
21 applicable license taxes and use fees, be issued a license
22 plate as provided by s. 320.06. Each application shall be
23 accompanied by a written military order or other official
24 document that proves that the applicant is the recipient of a
25 military decoration for valor.
26 (a) Notwithstanding any other provision of law, the
27 department shall develop a Valor license plate as provided in
28 this subsection. Valor license plates must bear the colors and
29 design approved by the department. The word "Florida" must
30 appear at the top of the plate and the word "Valor" must
31 appear at the bottom of the plate.

1 (b) The proceeds of the annual use fee shall be
2 deposited in the Grants and Donations Trust Fund and used as
3 provided in s. 296.38.
4 Section 3. This act shall take effect July 1, 2003.
